No, it is called sworn testimony
you might want to look up what happened at the pretrial, it is all there. You can ignore it, that is your right, you have the right to be ignorant.
If this is true, and not some made up bullsh*t, I will likely switch my position on this.
I currently do not believe a D@mn thing that the video guy is going to say. They have threatened him with prison and he will say anything they want him to say to get out of it.
If on the other hand, there is video evidence that they were shooting at him prior to the incident where he charged the man with the shotgun, I will consider that credible evidence that they have committed a crime and are responsible for his death.
But one would think this would have come out in the original police investigation.
Also, why would the other four prosecutors decline the case? If they have that sort of evidence, it would seem those other prosecutors are engaging in malfeasance to not pursue charges.
Something stinks here.
Here’s some facts, with citations for sources:
1. Arbery enters the construction site and looks around. (video + 911 call)
2. Nothing was taken from the construction site and nothing at the site was damaged (Larry English, the owner of the site, statement to the press)
3. Gregory McMichael calls 911 to report a suspicious person (911 call)
4. Arbery begins running (either resuming his run or fleeing, depending on how you want to interpret that (911 call)
5. Gregory McMichael calls for his son Travis, they grab guns and get in their truck to chase after Arbery (911 call, Gregory McMichaels statement to police)
6. They catch up to Arbery and try to cut him off, he turns around and runs the other way to avoid them (Gregory McMichaels statement to police)
7. William Roddie Bryan, a neighbor of the McMichaels, sees them trying to cut off Arbery and Arbery turning back, so Bryan decides to try and block Arberys escape (GMs statement to police)
8. Bryan apparently hits Arbery with the side of his truck, hard enough to leave a dent in the truck with clothing fibers embedded in it (Georgia Bureau of Investigation)
9. Bryan continues following Arbery and starts recording him running down the street (Bryans video)
10. The McMichaels take another route in an attempt to get ahead of Arbery and cut him off (GMs statement to police)
11. The McMichaels park in the middle of the street, Travis McMichael stands on the driver side of the truck with his shotgun, Gregory McMichael in the back of the truck with a handgun (Bryans video)
12. Arbery runs down the middle of the street away from Bryan who is following in his truck and toward the McMichaels (Bryans video)
13. Approaching the McMichaels truck, Arbery veers hard right to go around the passenger side of the truck, away from Travis McMichael (Bryans video)
14. Travis McMichael moves around to the front of the truck to cut off Arbery (Bryans video)
15. The two engage in a physical fight that ends with Arbery shot three times and dead (Bryans video)
16. Travis McMichael stands over Arberys body and exclaims f****** n***** (Bryans statement to police)
What evidence do you have that Ahmaud Arbery was an "active thief/burglar"? And please don't bother with the fact he got caught shoplifting once three years ago, because that doesn't warrant a death sentence anywhere. So what evidence do you have of him being a criminal at or near that time?
“So, you think a grand jury in Georgia was totally bamboozled by the prosecutor into returning an indictment on 3 totally innocent people?”
“Without a doubt.”
Well then, a Change of Venue is in order for the criminal trials. I’m sure Fulton County can impanel juries in a fair manner.
Your claim that Arbery was "hit" by the truck is not provable. A dent and an unreadable smeared palm print do not prove the truck impacted Arbery. Clothing fibers and a smeared palm print that have been in the weather for two months are bullsh*t as "evidence."
You also leave out all the previous visits by piece of sh*t thief Arbery to the neighborhood and the past stolen items, and you left out how the homeowner is deliberately lying about what was taken, and about asking people to keep an eye on his house.
In other words, you are presenting a sanitized version of saint Arbery that bears little resemblance to the reality of what happened.
I doubt you can find anyone who hasn't been tainted by the blatant lies and mischaracterizations of events. Everyone has been fed a narrative, and they will be no more able to find untainted juries for this trial than they can for the George Floyd case.
Fulton County has a very large and very diverse jury pool. Hopefully, that will ease your concerns that a fair minded jury could not be impaneled.
I also don't have much faith in juries in general and have long regarded them as a crap shoot that may or may not come to the right conclusion.
I've seen them fail too many times.
But as I said up above, if there really is a video showing them shooting at the guy while chasing him, then that's a whole different ball game. Such a thing would be clear evidence of culpability in his death.
There’s no law against that in the state of Georgia, as long as there’s no signage posted on the property (there isn’t) and as long as nobody with the authority to do so (such as the police or the property owner) has told the person to leave the site. Here’s a lawyer’s explanation of Georgia’s laws on the subject: https://www.youtube.com/watch?v=yr-HMjlr1sU
Further, plenty of other people (including some children) are on video entering the construction site. None of them were chased down, hit with trucks, or shot.
I'm assuming that the second part of that was meant sarcastically.
B) It isn't "my claim" that Arbery was hit by the truck. It's the claim of the Georgia Bureau of Investigation based on witness statements and their forensic inspection of the vehicle, Arbery's body, and witness statements including from Gregory McMichael himself. If you have a problem with that conclusion, take it up with them. I think the Georgia Bureau of Investigation's forensic crime unit is probably better equipped to make those sorts of judgements that either you or me, but it sounds like you have a far higher opinion of your ability to judge evidence you haven't seen.
C) Arbery did visit the neighborhood previously. So did lots of other people. There is no evidence to say Ahmaud Arbery has ever stolen anything from that neighborhood. Zero. Only pure speculation without a shred of evidence whatsoever. One must wonder why it's assumed Arbery is the thief who's taken things when Larry English has multiple other people on camera at his under-construction home besides Arbery. Truly a mystery why they aren't suspected of anything, but Arbery is somehow clearly the person responsible for all the bad things that have ever happened in that neighborhood.
D) Larry English didn't ask anyone to keep an eye on his house. He reported trespassers to the police and the was told in a text message that if he wanted someone to keep an eye on his house, there was a retired DA's office investigator living nearby. That alone is a very unusual response to a complaint to police.
E) I'm presenting all the facts we have that are indisputable. I understand you would prefer I throw in a bunch of unsupported speculation in an attempt to smear the man who was shot to death, but I'm not going to do that. You can feel free to throw out wild, unsupported accusations all you want, but I stick to facts supported by evidence. The timeline presented is all the events we have factual basis to believe based on videos, 911 calls, witness statements, statements of the accused to police, and physical evidence collected by investigators.
I reject your assertions.
This is fleeing thief aggressively attacks man holding shot gun and gets killed.
If there is no video that shows "they grab guns...jump in truck...drive past him. Shoot at him as he runs by.."
Then the case stands just as I thought. Aggressive thief foolishly attacks man with shotgun, and gets exactly what he deserved.
Men forced to rid the world of a dangerous parasite get arrested and charged on bullsh*t fake trumped up charges filed only to mollify the screaming tantrum throwers who will burn city blocks when they don't get what they want.
Has nothing at all to do with facts or justice.
They claim to have video off a surveillance camera off of one of the houses that shows “rody” video guy hitting Arbery with his Truck.
I believe it has not been released to the public, however I am sure the defense will get a copy during discovery.
This is what was testified to in the pretrial
You are always free to reject reality, but reality will continue to exist regardless.
More evidence may come out at trial that drastically changes the context of the events, but this is the general timeline.
