Michael Flynn Lawyer Sidney Powell ‘Mystified’ By Judge Sullivan’s Partisan Actions, Lays Out Next Steps
Redstate ^ | May 15, 2020 | Bonchie

Sidney Powell, attorney for Michael Flynn, appeared on Fox News yesterday to discuss the latest actions by Judge Emmet Sullivan. If you aren’t aware of his latest machinations, he’s essentially stalling on approving the motion to dismiss put forth by the DOJ, instead appointing a rabid partisan to argue against it. Not only is that almost unheard of, he’s also asking for amicus briefs from political actors in a criminal case, another move that is not only twilight zone stuff, but likely not even allowed.

In the interview with Sean Hannity, Powell described herself as being mystified by Sullivan’s gamesmanship.

(Go to 22:30 if the clip doesn’t automatically cue)

Ironically, Powell has spoken highly of Judge Sullivan in the past, leaving her more perplexed as to why he would behave this way. As she continues in the interview, she points out that there have been numerous Brady violations against her client, that the government was shown to have lied about document production, and that both sides are asking for this to be dismissed. There is no logic behind Judge Sullivan’s gambit to continue to persecute Flynn.

That leaves only one real possibility, one which Powell obviously can’t speak to right now because it could endanger her client. Namely, that Judge Sullivan is simply a partisan hack making political moves to damage Flynn and Trump before finally capitulating and granting the motion to dismiss. If anyone’s got a counter explanation, I’m all ears.

Regardless, Powell did appear on another Fox News show later that night and gave more context and some next steps

As she says, Judge Sullivan is in direct defiance of several precedents, including one recently set by the Supreme Court (written by Justice Ginsberg, no less). Powell also revealed that they are working on several motions that use those precedents and decisions as a basis to stop this nonsense. That’s likely what we’ll see in the next few days. If the judge continues to ignore the fact that he’s clearly violating the law, then this will almost certainly end up fixed by an appeals court. It’s so ludicrous that I don’t even think it has to make its way to the Supreme Court before Judge Sullivan is slapped down.

What we’ve seen here is an abuse of the justice system that can’t stand. Even though it’s a foregone conclusion that Flynn ends up a free man here, something needs to happen to this judge for what he’s done and continues to try to do. We can not continue to operate like this and still claim to have a system that’s blind. Currently, we don’t – Period.

Is this just to prevent Trump from hiring and back to the White House? Or appointing him to head the FBI?

Methinks that “Judge” Sullivan, being a liberal and therefore proudly carrying the standard of double standards, really hates the fact that a woman has made him look like the simpleton liberal shyster that he is. If he’s a judge, well, no use respecting that soiled profession any more.

Spot on. Fighting back always sends liberals into screaming hysterics. The banana republic judge probably had a stroke when he saw Powell on fox. Dems are use to dealing with doormat Republicans and not brawlers like Trump & Powell.

Flynn is under a gag order from Sullivan. If the case isn't 'closed', Flynn can't speak.

Any other questions ?

The procedure is a Write of Mandamus / Prohibition under Rule 21 of the Federal Rules of Appellate Procedure.

I think the Obama spying operations on judges, political opponents, etc. caught the Judge in some easily blackmailable situations. Could be cash under the table, some down low Gillum type stuff, or naked with some little boys. Whatever it is, he is pathologically frantic and throwing all caution to the winds.

A wet dream of mine is for Trump to re-hire him as FBI Director Mike Flynn and Flynn spend the next 4 and a half years cleaning house like a man with a mission.

Trump isn’t going to pardon Flynn, and he shouldn’t. That’s what Obama & Co wants but Trump is too smart to play their game. In fact, he was probably already anticipating this.

"...who’s to say they don’t have something on Emmet Sullivan, and they let him know it."

I wonder if El Corrupto Emmet Sullivan's name is on any of those "I killed myself in prison" Epstein's pedophile island flight logs, like "I did not have sex with that woman" Bill Clinton's name, which was there so many times.

I am betting that 'when the good judge is invited out to one of the worlds best restaurants in DC it's not by conservative leaning friends.

He has been very high in the Elite of power politics in the District of Columbia for 40 years.

I do not think that elite has any Conservatives in it.

This judge should be impeached.

I’m not mystified for even one millisecond. He’s an Obama monkey that hates Republicans and especially Trump. That explains everything he’s done.

Agreed. No need for anyone to pay or threaten Sullivan. He is all on board with the Deep State. If his Deep State masters told him he needed to hurl himself into a large vat of boiling lava in order to advance the Leftist cause, he would do so immediately, gleefully, and obediently.

I’m sure that was all fbi leadership. None of the rank and file would participate in such thuggery.

At first look, I thought that Sullivan is going to try to make Flynn so disreputable, so disgusting that he will be forever branded as a bad guy regardless of whether he escapes jail or not.

So rather than acting on orders from the swamp, could Juddge Sullivan be acting on orders from his superiors?

In other words, I thought Sullivan has gone mad.

But after meditating on it I have a question.

Suppose Judge Sullivan knows the law as well as Ms. Powell but is doing this because the higher authorities in the court system had a discussion with him and advised him that he had a much larger problem than deciding what to do with General Flynn, because what he must do with Flynn is predetermined....beyond his control.

The larger problem that he has but one which he can do something about, is the corruption in Flynn's former counsel.

The withholding of Brady evidence, hiding all kinds of information from Flynn as well as from the judge, committing perjury, suspicion of double dealing by working against Flynn while charging him exorbitant fees for representing him,,,,,on and on.

So just suppose Sullivan's reason for having both Ms. Powell and Flynn's former representation in court at the same time, which under any circumstances other than these would be bizarre, is to begin an investigation into the behavior of Flynn's former representation.

Far fetched? Might be but it is not any more far fetched than Sullivan's request that everyone be in court together.

It ain't for Kumbaya Pass the popcorn.

Not mystifying. Obama is trying to fix the trial. It’s not a coincidence that Obama said perjury first. Holder is probably talking to the judge about being loyal to the one.

Sooner than later this will go the appellate court by writ. When the defendant petitions, and the plaintiff joins the petition, the judge’s improper conduct will be all the more apparent

The thing is, as a liberal democrat no one has to tell him how to think or act. He doesn’t need to be coerced or bribed. He’ll instinctively do whatever it takes to prop up the left and go after the right. He obviously had it out for Flynn from the get-go and it showed all throughout the proceedings in his court. He so obviously displayed his partisan bias that he should never be allowed to be a judge again.

Appeal Sydney! Seek writ of prohibition on the issue of appointments of multiple amici curae and special prosecutor amicus based on the recent decision (Fokker?).

Also an affidavit of bias and prejudices for many reasons already of record.

They’re forcing a pardon, then will argue premature due to no “conviction”. More circus!
