Florida Gun Owners to Law Enforcement: Violate Our Rights & We Will Sue You

TALLAHASSEE, FL – -(AmmoLand.com)- Florida Carry, Inc. has put Florida’s top cops on notice: Stop violating the rights of law-abiding gun owners or you will get sued.

In a letter sent to every sheriff and police chief in the state (SEE ATTACHED), Florida Carry notes, “Despite the well-established right, our members have been repeatedly victimized and deprived of their rights by various law enforcement agencies and their respective officers and deputies. Too many individuals in law enforcement throughout the state have harassed, berated, belittled, arrested, and even killed law-abiding citizens going about their personal business, for simply exercising their constitutionally protected right to bear arms.”

The letter goes on to detail instances where the rights of their members, as well as other Floridians, have been violated by law enforcement officers who were either ignorant of, directed to or simply refused to comply with the law.

My spouse constantly says good LEO, Sheriffs, etc. online say they won’t confiscate and refuse. I’m not saying some won’t comply but I say I don’t believe it when push comes to shove. The oppressors will always find “good people” to kick in your door and haul your ass to the nearest gulag, concentration or re-education camp. Too much human history to back this up.

As I understand ... law suits are paid for by the taxpayer ... how is this a deterrent ?

Not sure how true this is, but I remember reading somewhere that the key is to put them on notice (i.e., directly inform the officers or officials during the encounter) about their qualified immunity and then remind them of:

U.S.C. Title 18, Sec. 241 & 242 - Conspiracy Against Rights & Deprivation of Rights Under Color of Law respectively.

U.S.C. Title 42, Sec. 1983 & 1985 - Civil action for deprivation of rights & Conspiracy to interfere with civil rights respectively.

The reference was to address the officer with something like, "Officer I duly place you 'on notice' to take cognizance to your Oath of Office steadfastly in ethics and integrity." Again, my understanding is that by putting them on notice it supposedly pierces their "Qualified Immunity" argument and opens the door to being to hold them individually accountable. Hopefully, someone more experienced with legalese could confirm or deny that.

Out of 380 calls out for welfare checks on veterans as requested by the VA only 10 needed help and weapons were placed in our evidence room. Only two are still there because of long term treatment. The others were given back. This only 1 year stats. We are thinking about billing the VA. This takes up to much time.

Totally agree. This is the wrong approach.

So the big threat is we will take you the government to a government court where ultimately government will decide if government did anything wrong and needs to punish itself?

Is that the plan when the commies get full control again and decide to go national with these red flag confiscations where swat teams show up at your home at 1am and seize your property and only means of defense against crime or tyranny without any due process?

I applaud their efforts and hope it works out but I don't think suing local government is the answer. Red Flag laws are utterly unconstitutional and they are being abused on a daily basis in FL. Get a case together and get it to SCOTUS asap. These laws need to be thrown out now.

How strange. In my county, pig cops who harass citizens exercising their rights get a visit from the sheriff. Within a week or two, the targeted cop resigns and moves out of the state.
