Powell had said repeatedly she did NOT want to have the plea withdrawn?

Becasue the claim is that the guilty plea was obtained through fraud and misconduct by the government, which merits dismissal with prejudice. If the sanction on the government is that Flynn has to go to trial, well that is no sanction at all. That is punishing Flynn for the government's misconduct.

And Powell is in the position that she has new information about government misconduct- that FISA warrants were obtained through fraud without probable cause, which we all now know because the FISA court has grudgingly admitted the fact.

I’d add Flynn’s original lawyers, who were more interested in protected the Deep State than their own client.

A big “red flag” for me has been the incessant reporting and FR posts about how the DOJ screwed Flynn by threatening to prosecute his son.

I have seen nothing about this from an attributed source, including Flynn himself, or even his attorney who is all over TV talking about the case.

Instead, these reports can invariably be traced to fifth-rate “conservative media” outlets that peddle fake news as badly as CNN does.

The problem was that the proof of government fraud and misconduct was not available BEFORE the guilty plea, because the government and the FISA courts themselves have spent four years stalling and preventing their misconduct from becoming available.

Furthermore, at the time of the guilty plea, the Mueller gestapo was actively threatening to make up charges against Flynn’s son.

Sullivan gets fair too much credit for being intolerant of government misconduct. He actively presided over the destruction of Senator Ted Stevens career and reputation before finally overturning the conviction after his political carrer had been ruined, in the face over overwhelming evidence over government fraud and misconduct that would have easily led an appeals court to overturn the conviction and admonish Sullivan. And now he lets the Flynn persecution continue into its fourth year.

Judge Sullivan has a well-earned reputation for fairness and disdain for government misconduct.

He has also demonstrated a capricious bearing. I wouldn't want to be in Flynn's shoes subject to Sullivan's whims.

He can bring a ‘defamation of character’, libel and ‘character assassination’ litigation against them.

THAT’S the long-standing ‘remedy’ in the law, ratified to shield people against groundless allegations. In this case, the groundless and intentionally damaging allegations made by reckless and out-of-control public officials who have broken laws to purposely defame Flynn.

Everyone targeted by this wholesale fraud has legitimate recourse available to them. What else can thwart Liberals’ incessant and by now open, assault on the social stability and established political standards in America…because it is nothing less? Somehow, Liberals got the idea they can accuse anyone of anything!!

There is a tremendous difference between liberty and license. Liberals’ unopposed attack on Flynn is really a dangerous precedent. If Flynn is falsely charged, no one can escape the kind of license Liberals have assumed.

1. See Post #27 about Flynn's son.

2. It didn’t matter what evidence of government wrongdoing was available in 2017. By pleading guilty Flynn was signing a sworn statement attesting to things that HE WOULD HAVE KNOWN BETTER THAN ANYONE ELSE.

3. Related to #2 ... the evidence of government wrongdoing would have come out much faster if the case had actually gone to trial. This is one of the things I have in mind when I say that Flynn’s defense has been incoherent.

I don’t recall that any FISA Warrant applied here?

They do have Emails that show that demonstrate between Page and Storzk showing Pieztkenka 302 interview notes were re-written after the fact to make Flynn appear to have lied.

There’s no FISA issue here in this case. Flynn was under “indirect” surveillance in his phone calls with the Russian diplomat Kislyak. There’s no FISA warrant required to monitor a foreign official.
