The last thing Powell wants is a trial. She was legally obligated to make this motion to withdraw. There was a reason why she insisted before that she did NOT want to withdraw the plea. She trapped herself because she lacks legal acumen.

Are you crazy? The last thing THE GOVERNMENT prosecutors want is a trial.

At that point she can ask for a dismissal WITH PREJUDICE so that Flynn can get back all the money this has cost him.

You may be surprised.

Flynn knows where the bodies are buried, and a trial allows him to testify to it under oath, should he so choose.

Like a Senate impeachment trial, the derps are the ones that fear the truth coming before the public. They're the dirty ones. We know this.

I vote trial in both cases.

You mean the DOJ/FBI commit multiple material frauds on multiple courts, Powell comes in late in the game, and you are finding fault with her conduct?

Boy, Flynn is really in a bind now. Trial with the possibility of hard time? and all its expense and uncertainty? or a reluctant plea with probation and closure.

The government has made this really difficult for him. Some of it he brought on himself. Sidney Powell has done a stellar job without much to work with originally.

“Dismissal with prejudice” means Flynn “wins.” It is not the same as an acquittal, but close. The judge dismisses the case because of some error or other reason, but the government cannot refile the case.

When the government requested a sentence outside the plea agreement, Powell was legally obligated to move to withdraw the plea. Repeat: Powell made the motion because she had to, not because she wanted to.

Powell had said repeatedly she did NOT want to have the plea withdrawn? Why is that? Why not just do back then what she is doing now?

But her prior futile legal maneuvering caused the government to ask for a sentence increase, and thus she trapped herself into doing what she did not want to do.

I for one still don’t trust Judge Sullivan. In the first hour before the Judge he called Flynn a traitor. He took it back after it splashed across every TV screen in America. The main stream media ate it up. Trump had military traitors working for him, he must be a Russian mole.

Taking it back does not count. What the heck (nice word) was he thinking in the first place? What was his mindset? He had to have been touched by TDS.

There are some Freepers who know the law much better than I do, but I’ve been saying for months that the whole defense of this case has been incoherent. Flynn’s legal team is making arguments now that would have been far more effective if they had been made BEFORE a guilty plea was entered.

Heck ... this week’s circus revolves around the sentencing hearing for a “crime” where the plea deal was made MORE THAN TWO YEARS AGO.

The ‘evidence’ at trial would need to be thrown out because of prosecutorial misconduct.

Specifically, the original FBI interview documents- the ORIGINALS - are missing... A near impossibility in the FBI’s document retention system. So all the prosecution would have is the ‘edited’ version- which would immediately be thrown out.

The last thing the government wants is a full trial.
