Washington state sues Trump over diverted military funding

Washington state's attorney general sued President Donald Trump on Thursday over his plan to shift more than $3.6 billion in military construction funding to help build a border wall.

In Washington state, Trump's plan would divert $89 million from a pier project at a submarine base west of Seattle.

State Attorney General Bob Ferguson filed the lawsuit in U.S. District Court against Trump and other administration officials, saying it was a "misuse of his presidential emergency powers to accomplish an ideological political goal."

The cuts stemmed from a Feb. 15 declaration by Trump that a national emergency exists at the border that requires the use of the armed forces.

A secure border is as essential to national security as a strong military. Maybe even more so.

I think he won on getting the preliminary injunction lifted. Thus, they can sue but Trump can keep building until the suit is resolved.

These America-haters could not care less about money being diverted from the military (which they also hate). It’s about blocking the wall and letting President Trump get a win.

Similar, but different.

The July ruling was over the use of DoD Counter-Narcotics funds (explicitly authorized by 10 USC 284).

This is over the use of DoD Military Construction funds, which requires a Presidential declaration of emergency under the National Emergencies Act (authorized by 10 USC 2808).

It's in the Orange Man Bad penumbras of the 3rd Amendment, which deals with quartering of soldiers in private homes.

The Administration has known to expect such a lawsuit, since they first considered declaring an emergency, to use Military Construction (MILCON) money.

Because of the emergency nature, they should get quickly (relatively speaking) elevation to the Supreme Court, if (as we would expect) they get enjoined by another partisan hack judge. It would likely have to go through the Ninth Circuit first.

The whole issue of any of the hundreds of District Court Judges imposing injuctions on the President, may be coming to head, due to its extensive abuse since President Trump took office.
