Many cars have blue tooth hands free systems...does the law differentiate use vs use as in talking through a blue tooth system while hands are on the wheel vs. texting?
Also many people use their phone as a GPS & map. Is it illegal to clip your phone to your dashboard with the map up?
“An act relating to motor vehicles; authorizing a peace officer at the scene of a traffic crash to use technology to determine if a driver was using a handheld wireless communications device at the time of the crash”
That’s not searching a phone.
Dishonest writing.
the phone gps feature does have a voice turn by turn feature as well.
Sweet. Can’t wait until Harry Reid or any other politician is involved in a car crash and we get to search their phones!!!@!
I like the GPS’es built into the rear view mirror with voice. Even though the view is a bit smaller than phone or built in front panel gps’es, the location allows your eyes to stay forward and on the road and to not be forced in glancing even briefly away from the windshield, down or sideways.
If that is the case, I foresee lots of people having multiple phones.
Ten minutes? LOL! They'll need to make sure you weren't just texting, but also not changing the stations on your Pandora account or entering driving directions on your map. They're going to entrust this job to some data company with a juicy state contract and they'll quickly get backlogged.
It'll be weeks, if ever, before you get your phone back.
Time to get a burner phone. "Here you go officer."
Why is this needed. What will happen at an accident, some copper stepping over injured to seek out a smart phone? What is he going to do ask the phone was it in use? So what does that prove? Wow they get to write a ticket.
It will become mandated that every car be equipped with blue tooth signal lights that will flash different colors when the drivers are using different apps.
Half the time I don’t even have a phone with me. Hard to take something I don’t have.
“Thats not searching a phone.”
Right. And no such law has ever been abused, either. /sarcasm
It’s generally held that once police are allowed access to a vehicle or home, any content they see can be legally searched and investigated.
“Wow they get to write a ticket.”
At some point insurance companies will most likely refuse to cover accidents where someone was on the phone.
LOL when I saw who posted the article.
Just read the law.
That is four pages of very scary.
And I’m no lawyer, but I can’t believe, if approved, this thing will pass constitutional muster.
Why not just go to a judge and get a frickin’ warrant? !
Did you read the bill? “On the phone” is not clearly defined.
That, to my mind, is a huge problem.
My phone password is so complicated - I forgot it.
I’ve kinda wanted to test the system by holding a broken cell phone to my ear while passing a cop and seeing what they do about it.
Officer, I wasn’t talking or texting. I was just holding this useless piece of plastic and glass. What makes that different than a cup of coffee, or a Big Mac?
Easy solution. Buy a cheap o burner phone that you rarely use. Use your regular phone like normal. If you get in a wreck and the cop your burner phone, no need to tell him about the one in your pocket.
