If Roberts was really as smart as he should be he would have announced that he had to recuse himself from making any comment. How can he be both judge and defendant (so to speak) in the same case?

Many posters here wonder if it’s not the other way around. As Obama’s bitch, Roberts may be setting the circumstances so that he’ll HAVE to recuse himself due to conflict. When he does that, it’ll be 4 to 4. When the vote is even, the ruling of the prior court — the NINTH CIRCUIT — will stand. That ain’t good.
