If that were the case, then Federal judges could not insert themselves into every vote recount, as they did in Georgia and Florida, nor rule on re-districting, or rule on voter ID.

I don’t know the legal details, but we certainly see federal judges over-stepping themselves on a regular basis. I believe the DOJ under Trump has indicated an interest in slapping down federal judges who think they control things which they certainly do not control.

If nothing else, it would be nice to have a firm precedent that federal judges CANNOT insert themselves into every vote recount. Or rule on redistricting. Or Voter ID.

It’s a state issue. The feds are involved for constitutional questions. DJT could ask for a conference of governors to bypass the House.......or get the House to fix it before they leave office (good luck).
