This is what Mark Steyn was talking about when I got in on very little of his subbing for Rush Friday...that the judge was way off base in his interpretation of “due process” in the constitution. Maybe the president should bring that up in his tweets. Sure he appointed the guy but he can’t assume they are all going to know or follow the constitution so no big deal admitting that this one was a “mistake.”
What if Acosta was believed to be a terrorist. Would the White House have to continue his press pass until some sort of “due process” (Whatever that might be for a press pass. Seems to me that whoever issued it can use the same process to revoke it) or he blows the place up, whichever came first?
This judge should have his courtroom filled with reporters asking questions and disrupting. And if he threatens anybody with contempt, they should shoot back that he has no right to such action without the same due process he ordered upon the executive branch. His, after all is an equally accountable branch of government and has traipsed too long excluding the media from covering it procedures... in the interest of transparency and all that.

The judge relied on a 1977 case from the federal appeals court in Washington, D.C., where judges ruled the Secret Service couldnt deny a press pass to a reporter in an arbitrary way without notice or an opportunity to rebut potentially violating the 5th Amendments right to due process.
So in 1977 they pulled this. And that is now a precedent overruling the Constitution. There is no right to a press pass for within the White House.
No one has said Acosta could not be a member of the press. No one has said Acosta cant report. The White House has revoked his visitor privileges.
If this is made to be a new precedent, we are in trouble. We arent supposed to be changing the Constitution under the phony guise of interpreting it. Tomorrow the WH should put up a list of policies that are common sense involving considerate adult behavior and respect for White House rules, and have everyone admitted to their press room sign. Period.

Yeah, its fine, I mean its not a big deal. What they said, though, is that we have to create rules and regulations for conduct etc. etc. Were doing that, were going to write them up right now. Its not a big deal and if he misbehaves, well throw him out or well stop the news conference, Trump said.

I think, long term, its a win for the White House and actually for future presidents, because this was a very tailored decision that wasnt related around the First Amendment and unrestricted access to the White House, but on a due process side.
And the president today and Press Secretary Sarah Sanders have indicated theyre going to developing procedures and protocols to be followed. And then that will give them the future ability to take necessary actions if decorum and procedures are broken.
Visiting the White House is by invitation. No one is owed an invitation.
Folks, this decision is a GOOD DECISION made by a GOOD JUDGE who is faithfully FOLLOWING THE CONSTITUTION. Time will show you this will benefit the Trump White House tremendously. It will have the White House laying out the required standards of behavior by accredited members of the WhiteHouse press corps, penalties for violating those standards and PROCEDURES for implementing those penalties.
When fully in effect, decorum will return to the White House press conferences. Ironically, Trump will, in a real sense, owe that return of decorum to Acosta. It will be sweet to see Trump rub that into Acostas face.
Is he implying that other Federal judges know the Constitution?
I concur.
No jurist should give this farce the patina of legitimacy.
