In this case Byrne alleges that he was specifically targeted
Do you have a free link to the complaint?
Very interesting. Thanks much for your insight and for sharing your experience!
It makes me wonder WHO can go after the Clintons.
Maybe the question is: Who (legally) is harmed when a government employee or pol enriches themselves by selling access or US resources?
And what laws did they break?
It’s pretty clear that their non-profits stink. How can they be taken down?
I have now read the Byrne complaint and I can state with near certainty that he will not succeed and the court is highly likely to grant a motion to dismiss. The complaint is 829 paragraphs and lays out the claims against the defendants in a fair amount of detail. The allegations include the uranium deal, email server, Russia investigation, etc., but even if we except the truth of the allegations — as the court must when determining a motion to dismiss — Byrne fails to specifically allege, as he must, how the alleged racketeering activities have injured his business or property. In other other words, he fails to allege any facts that, if true, establish that he has suffered an injury that is separate and distinct from the injury suffered by the population as a whole.
Although Byrne does allege that David Brock and other defendants repeatedly defamed and damaged him in retaliation for his book, and that as a result his book sales suffered, defamation is not one of the “predicate acts” (i.e., racketeering activities) included within the RICO Act.
Opponents can ESAD!!
ANYONE CAN FILE A SUIT FOR A RICO VIOLATION.
EDUCATE YOURSELF, DUDESS!
The Ugly, Fat Unindicted Criminal Cow is finally toast!!
Deal with it!
Ignore the Clinton lovers...
No one has standing when the Swamp says they don’t.
Certain!y not We The People who fund these crooks and are persecuted by them.
Swamp: I’m sorry, you don’t have Standing.
No standing allowed. You go sit on the floor along with all the other patsies who pay for us.
(I hope I’m wrong.)
So who can file a successful complaint about an "injury suffered by the population as a whole?"
Please give me your thoughts.
The attorney general in a criminal RICO action.
That is patently absurd, and validates the statement, "First of all we shoot all the lawyers."
If a RICO crime devastates the lives of every citizen then it's OK to tolerate it because my loss as a citizen is no greater than every other citizen.
Even though as individuals we are all, tens millions of us citizens, equally devastated, losing our individual wealth and even our freedom.
Only a lawyer would have the bal** to mount such an argument: In committing a RICO crime, make sure it's enormous enough for any individual not to be able to claim individual damages.
Since every American citizen is affected negatively, and in a real way.
If a RICO crime devastates the lives of every citizen, then the United States Attorney General is responsible for prosecuting the case -- but individuals can't prosecute RICO unless they meet the standing and proximate cause standards that I have previously laid out in other posts.
