The agency tells a federal judge that it is investigating and 'sincerely regrets its failure.'
The National Security Agency destroyed surveillance data it pledged to preserve in connection with pending lawsuits and apparently never took some of the steps it told a federal court it had taken to make sure the information wasnt destroyed, according to recent court filings.
Word of the NSAs foul-up is emerging just as Congress has extended for six years the legal authority the agency uses for much of its surveillance work conducted through U.S. internet providers and tech firms. President Donald Trump signed that measure into law Friday.

spoliation of evidence is the intentional or negligent withholding, hiding, alteration or destruction of evidence relevant to a legal proceeding.
A judge will typically instruct the jury to weigh spoliation heavily in determining outcomes — meaning it’s very bad for whoever did the spoliation.
Judges could on their own declare mistrial or automatic civil penalties based on the severity of spoliation.
Now, on these FOI suites the plaintiff is suing for the information. If it’s spoliated ... no penalties are involved and no criminal referrals. That’s why this shit happens. No punishment. Hell, the person who takes the blame will traditionally get a promotion.
If we don’t see the American royalty in orange jumpsuits after all this is laid bare, we will know that all this talk about all being equal under the law is nothing more than legal BS.
Were I the judge, I would jail both the NSA person in court, and their lawyer, for contempt of court; until ALL records were produced.

I would think maybe a five year sentence for destroying information. A contempt of court charge. something!
I was inspired by the juxtaposition on the page of a photo of Barney Frank waving a pen around, followed a few comments later by your "give them the pen" comment. :-)
