Before Justice Department lawyer Terry Petrie could return to the witness stand today for cross examination by the defense, prosecutors were arguing before US District Judge Gloria Navarro over the defense's questions to Petrie yesterday.
They were call the questions of Cliven Bundy's attorney Bret Whipple and those framed with the US Constitution by Ryan Bundy, acting in his own defense, an attack on the prosecution.
The prosecutors are accusing the defense of attempting jury nullification.
Trial observer John Lamb posted a video at the lunchtime break discussing the FBI threat assessment, a 15 page document that is redacted in many places, that has finally been given to the defense.
Because Judge Navarro is not allowing the redacted document to be read aloud in court, jurors cannot hear information that paints Cliven Bundy in a positive light, information that the prosecution labels "self-serving" in its arguments.
Court will be in session for the trial next week Monday through Thursday with a special hearing on motions in the trial as part of Wednesday's court activity. The defense still has a motion before the judge for dismissal.
There will be no trial activity the week of December 4th.
The trial will then resume on December 11th.
