Rosenstein's Authorization To Mueller (ray76)

Rosenstein's authorization memo appointing Mueller does not state the grounds for the authorization:

• what violation(s) of law are suspected
• what evidence exists to support those suspicions
• a time limit for the conduct of the investigation

Instead the authorization memo grants an unlimited amount of time to investigate any individual associated with the campaign and any "link" they may have with the Russian government - or - any matter that arises during the investigation. It is a completely wide open investigation yet no violation of law is alleged.

The U.S. Code of Federal Regulations requires that a special counsel not be appointed unless and until it is determined that there are grounds for a criminal investigation. 28 CFR 600.1

Excerpt of the authorization memo:

(b) The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James 8. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017, including:
(i) any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump; and

(ii) any matters that arose or may arise directly from the investigation; and

(iii) any other matters within the scope of 28 C.F.R. § 600.4(a).

(c) If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters.
Rosenstein’s authorization to Mueller cites Comey's testimony, “The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017...”

Comey in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017 explicitly and unambiguously described a counterintelligence investigation of alleged Russian interference in the 2016 election. Comey testified that the investigation includes the DNC's "hacked" e-mail systems and the "leaking" of those e-mails. Why is this not included in Rosenstein's authorization memo?

Recent evidence shows that DNC contractors had access to DNC e-mail systems. These contractors have fled the country, except one who was arrested while fleeing. It's entirely possible that these DNC contractors are the source of the "leaked" DNC e-mails and that Russia had nothing to do with it. Why is this not being investigated?

Why does Rosenstein exclude from investigation of alleged Russian interference in the 2016 election the activities of individuals associated with the Democrat candidate, such as the DNC and their contractors? The allegations of Russian interference began with the alleged Russian "hack" of the DNC e-mail systems. Why is this not investigated? Why has the DNC refused to allow investigation of the e-mail systems?

Why is Rosenstein's authorization confined to only the Republican candidate? What evidence is there to support the allegation of a "link" between the Russian government and any person associated with the Republican candidate? Why aren't persons associated with the Democrat candidate investigated for any "link" with the Russian government? Or any other government? Why aren't links between the Clinton campaign and the Ukrainian government investigated, for example?

Again, Comey testified that there was a counterintelligence investigation of alleged Russian interference in the 2016 election. Rosenstein authorized Mueller to conduct that investigation but then confines the investigation to only individuals associated with the Republican candidate. Why?

Why are individuals associated with the Democrat candidate excluded from investigation?

The integrity and impartiality of this investigation might reasonably be questioned.

My theory is that the authorization language was written by Comey and Mueller and provided to Rosenstein. Rosenstein used to work under Mueller in the DOJ in the ‘90s.

They all need to be put under oath and questioned about contacts and conversations leading up to the appointment, and then cross-check their accounts against emails and phone records and any other witnesses.

Special prosecutor is supposed to be invoked if there has been a crime committed. No crime has been committed and the republicans, and of course the Dems and media have stayed silent on this matter. Collusion isn’t a federal crime, if there was conclusive evidence of collusion between Trump team and Russian officials it would be a political matter but nothing criminal in nature. Mueller is fishing for anything they can dig up to justify the process and that includes perjury trap on Trump staff on benign subjects like ‘you lied when you said that you ate a ham sandwich on Tuesday, it was roast beef’.

They can not go away empty-handed now in their mind

The only way this thing works out for President Trump is that something comes out about this conspiracy and coup to toppled him is exposed and that Mueller and team along with Dems have to go away

Firing Mueller isn’t so easy now because obviously most of the Republicans are now backing not firing him and Mueller probably wants to be fired because then the goal of bringing Trump down or at least stymie his agenda for next 3 years will be complete

Firing Mueller would be a huge mistake. Firing him would only feed the Democrat’s narrative of “obstruction” and would give the Democrats their lusted for “Saturday night massacre”.

A wiser course of action would be to continually point out that the authorization is improper. Essentially, embarrass Rosenstein into withdrawing the authorization, or at the very least to specify what violation(s) of law are suspected and what evidence exists to support those suspicions.

As for Mueller... this post is all about Mueller’s actions. I omitted to mention that he is operating far beyond the scope of the improper authorization. Tax returns from a decade ago have nothing to do with the election.

The facts need to be brought to public attention, pressure must be brought to bear on Rosenstein to withdraw the authorization. If he doesn’t then just humiliate him, call him incompetent, and so forth. Likewise for Mueller. All the questions I’ve asked, all the Democrat bundlers and Clinton Foundation lawyers he’s hired... ZERO credibility that he is conducting an impartial investigation.

I think the Ace up Trump's sleeve is Mike Rogers (Head of NSA). Rogers met with Trump a few days after he was elected, and supposedly spilled the beans that there was going to be an attempt to get him impeached, and that he was being spied on. Since before he was sworn in, he has been preparing to defend against this. No matter what the SC does, it is probably being watched, and at the appropriate time, all information Rogers has can be declassified by the president and presented to the American people.

(b) The Attorney General shall consult with the Assistant Attorney General for Administration to ensure an appropriate method of appointment, and to ensure that a Special Counsel undergoes an appropriate background investigation and a detailed review of ethics and conflicts of interest issues. A Special Counsel shall be appointed as a “confidential employee” as defined in 5 U.S.C. 7511(b)(2)(C).

Presumably Rosenstein. He should be asked the question and be made to produce evidence that a background investigation was conducted, and that a review of conflict of interest issues was conducted. Produce documentation, Rosenstein.

Who's budget is paying for this? They have a blank check, but its our money and that ain't right to open any government contract without fiscal accountability... go after the money, is how you shut them down, those greedy democrats wont work for free, if the money dies up, they will too...

That’s exactly what happened.

It’s a set from the get: how the J. Edgar Comey and his Big Brudder keep themselves in power: blackmail and extortion. Anyone who crosses them...gets investigated.

Did you fill out a form wrong? Did you hedge a bit, wondering if what you did was a problem? They pounce. Any little thing.

The guy waltzes in and 1 week later every sleazeball Rat Party operative is working for him?
