Those of you following along at home might be having a remarkable feeling of Deja-Vu with the similarity between Hillary Clinton’s approach to her emails containing classified information, and James Comey’s approach today to reports of his leaked memos containing “classified” intelligence. The defensive narrative ‘fact pattern’ appears identical in sequencing:
Step 1 – The emails/memos were not classified. √
Step 2 – The emails/memos were not ‘marked’ classified. √
Step 3 – The emails/memos were ‘retroactively classified‘. √

Next up in the logical sequence:
Step 4 – Missing/deleted = Wiped Comey memos: “what, like with a cloth or something?”
Step 5 – Robert Mueller (filling the role of Comey circa 2016) will hold a 2017 presser to say: James Comey didn’t intentionally violate the law with sharing classified information within his leaked memos in 2017. Adding: “we could find no intent” by him to do so.
Step 6 – Mueller will conclude his presser by saying: “no reasonable special counsel would recommend charges“.

There is NO SUCH THING as “retro-active” classification. Once it is out in the public, there is no bringing it back.
You can not have a top secret document that has been made public, because you can no longer rely on it being secret.

The memos, whether marked classified or not, were government property, and not his to desemminate to his leaking friend, or the press.

The Memos Were “Retroactively Classified?”
No, the information was Classified before Comey wrote the memos and he included the already classified information in the memo.
When he included the CI, that is when the memo also became classified and when he, by his own testimony, intentionally leaked the memos is where he broke the law.

Appears to me that the salient issue regarding Mr. Comey’s sleight of hand with classified documents is the fact that he was a civilian at the time of the deed. His pathetic excuse after his termination was to assure that the information would not get buried and never be released to the American people. It may be difficult for Mr. Mueller’s investigatiors to “overlook” this crime. Comey’s “friend” who released the documents to the news media also has some “splaning” to do.
This is the “I’m too stupid to recognize what’s confidential.” defense. Hey, it worked for Hillary!
OCAs are required by law to RECOGNIZE, CLASSIFY, and MARK any material they originate or encounter that should be classified. Doing so is a fundamental requirement of their job!

HRC aas the State Department'x top OCA -- yet, she admitted that she never classified anything, and depended on others to do that job for her. BUT -- her private e-mail system totally bypassed those other OCAs -- meaning that anything she sent went out into the world -- unclassified and un-marked.
Comey has zero excuse for writing down classified information -- and NOT classifying and marking it as such!
