You will also take possession by military force of the printing establishments of the New York World and Journal of Commerce, and hold the same until further orders, and prohibit any further publication therefrom.

He did not arrest the Maryland Legislature. He arrested several members in September 1861 who were advocating a secession vote. Note the date. At that point the Southern states were waging civil war against the government and these people were talking about joining the rebellion. Given that, what should have happened to them if not detainment?

The day before a forged proclamation had been published in the Journal of Commerce, the purpose of which was to manipulate gold prices and make an ill-gotten fortune for one or two of the writers. On the face of it, the purpose was to harm the government, give aid and comfort to the enemy, and that is in and of itself a treasonable offense. So arrests were certainly in order.
