I would far rather see the appellate jurisdiction of the federal courts restricted from interference in social issues.

That is exactly how the Founding Fathers would have handled the problem of Leftwing Activist Judges. Under Article III, Congress can absolutely accomplish that purpose by a simple act to that effect. I have long criticized Congressmen claiming to be Conservative for not working together to do just that. The problem seems to be that the "Politically Correct" types are unwilling to work together--that is different afflicted or offended groups working together--to stop all forms of social engineering.

Had the Founding Fathers not had the required level of mutual respect, the Constitution could never have been ratified.

I have heard it said by other Republicans that they don’t want to do this because the D’s will then do the same. Whatever our strategy is now, it is not working too well. Actually, it is a catastrophic disaster. Wasn’t it a Bush (W)-appointed judge who ruled that Sodomites should be given marriage licenses? Use Congress’s power on this issue and let the D’s stew about it.
