While there are definitely similarities, there are also differences rendering this case to not be a precedent for Ted Cruz's situation. For the question now becomes did his mother exercise her rights as a citizen before Ted attained majority? Did Ted's mother ever renounce her citizenship in either England or Canada? Until these questions can be determined Ted Cruz's citizenship remains in question. Also the fact that Ted Cruz held a Canadian citizenship up until 2014 would still require proof that somewhere along the line she was in fact eligible to confer her citizenship to Ted.
Bottom line, all of these questions guarantee he is not a natural born citizen, and questions remain as to whether he is in fact even an American citizen.

And I also agree that the facts don't fit the Cruz situation, seeing as how neither of Boyd's parents was a US citizen when Boyd was born.
Ted's mother was born a US citizen, so one question is whether or not she still had that status when Ted was born.
As to his NBC status, I see Rogers v. Bellei as controlling. Cruz is naturalized, at best, and if his mother was not a US citizen when Ted was born, he is an alien.
In researching the Canadian election process, there’s historical descriptions of the voting process throughout the years. They explain exactly how the Cruz’s were added to the voting rolls as Canadian citizens. And only as canadian citizens.
During the fifties and the sixties Canadians began challenging the authorities with charges of disenfranchisement. Canada quit operating in darkness and made it a goal for all ethnicities, races, religions, parties, and those over 18 to be registered to vote.
In urban areas, a pair of Election Officials- Enumerators, canvassed door-to-door over an entire precinct. “Knock-knock”

2. Are you a Canadian citizen?
3. Are you over 18 years old?
4. What is your occupation?
5. Do any others reside here ?
The information was transcribed and reviewed by the Supervisor of Elections. All those that were certified were placed on the voting list. The list was then posted throughout the precinct in designated public places. It was your civic duty to check these lists. If you had been left off the list in error, you were to contact and petition the supervisor of the election board with proof of address and ID.
This was an official job of the enumerator and intentionally omitting or adding people would have resulted in termination, at the very least. This system of canvassing for voters was in place throughout the 1990’s.
Until 1984, the posted list notification system was used for voter verification. If you didn’t bother to check the list the 30 days prior to the election and notice your name missing, and correct this, you would not be allowed to vote. Due to privacy concerns, they switched back to a post-card notification system for the voters.

The Cruz campaign denies Eleanor citizenship by virtue of her not being in Canada long enough. No one really knows how long either parent was there. Note that Rafael could have obtained Canadian citizenship using his Cuban refugee status. Eleanor may have left Britain with a British passport or residency status since she lived there for 6-8 years. That residency or citizenship would also shortens the Canadian timeline down to only one year.
The evasion by the Cruz’s is the answer to the question.
Ted is not an idiot and he would have always known he was born in Canada. He would have considered any perks. He would have known that it was a haven for draft-dodgers of the Vietnam War. He would have known it was an alternative to his American citizenship when he obtained his Drivers. License and Passport. Note that he did not clear the issue up quickly when the Dallas News reported his Canadian status. It took him 15 months.
If Cruz’s ultimate goal was to be the President of North America, his status would be ideal.
