I just heard the O'Reilly Factor where Cruz and Rubio were interviewed.
The first revelation is that their immigration policies when it comes to deporting illegals is virtually identical to Trump's including the part about rounding up the 11 million illegals and deporting them. I was simply amazed. O'Reilly asked both candidates if they would deport the 11 million illegals and they both said that they would. Six months ago they were not this clear about immigration deportations.
The more interesting answer was from Cruz. O'Reilly suggested that it could not be done because the illegals were entitled to the due process provision of the law. Cruz emphatically said that this was not true and that using ICE the president had the total legal authority to deport illegal aliens in this country. Cruz re-emphasized that with his legal background this was the case.
O'Reilly argued a bit with Cruz and Cruz said that he knew for a fact the president had the total legal authority to deport whoever is here illegally without going through the courts.
Cruz in essence confirmed that what Trump wanted to do regarding deportation all these months is 100% legal and doable under the authority given the president. That was an amazing admission on Cruz' part and a confirmation that Trump as president can indeed deport whoever is in the US illegally. It also confirms that Trump has some pretty good legal advisers on his team and that he knows exactly what he is talking about.
Deportations ARE well within the President’s authority. Clinton deported thousands, which Bill O’Reilly seemed to forget. All that has to happen is for those responsible for carrying out the deportations to be allowed to follow the rule of law and do their jobs. Ted Cruz knows this and fully supports it. There will be no dramatic rounding up of illegals and forcing them onto trains in the middle of the night with accompanying Elian Gonzales style photographs. Just taking every case on, one at a time, and quietly enforcing the law for American citizens.
He may have said he would deport IF, etc., etc. but you made it sound like he and Cruz agreed with trump on deporting the eleven million. Cruz said that, Rubio did not. He went through the measures he would take to protect the borders and enforce the laws, he then added he did not think Americans would support a mass round up of people. ( and the majority will not and will never happen, no matter what Sunkist says)

Now, if, a detainee is in fact an illegal alien, the court will rule that the deportation is within the President's legal authority. But the President can't claim unreviewable or unchecked power in America.
We don't have a king. Even if you trust a Republican President, what about the next time a Democrat is in power?
Can you imagine a Democrat President deciding to deport, say, a prominent conservative activist? It may sound unlikely but how exactly would you stop something like that without having the opportunity for judicial review?

Not entirely true. Courts will find a way to slow down some of it but it doesnââ¬â¢t matter, if thereââ¬â¢s a will, the President can certainly do plenty.

You are correct for a relatively small number of cases that find their way into the federal courts system following Executive Branch action. Plenary jurisdiction lies within the Executive Branch and the lions share of cases are administratively decided by DOJ Immigration Judges and administravely reviewed by the DOJ Bureau of Immigration Appeals.
Then JSC has achieved perfect balance, as he is also misrepresenting Trumps.
Well now, if you think Cruz is lying but not Trump or Rubio, you need to sit this election out. Because both Trump and Rubio are pulling really effective Alinsky techniques on Cruz.

why is this amazing? Cruz has had this stance for years. Cruz was for building a wall and deporting illegal aliens when trump was for amnesty
I admit that Cruz is an excellent lawyer and I'm not a lawyer at all, so maybe he is, in fact, right as to the law on this. (The unappealable and secret no-fly list is an unfortunate precedent.)
However, I do know that even if Cruz is right, it's a very bad idea (and not a conservative idea) to give a President the power to take action against an individual without any right of review.
Consolidation of power in the office of the President is something I expect to see from liberals.
