because US industry runs on diesel trucks of all sizes.

I think the more onerous result of this “deception” is the burden on the owners. I live in Maricopa County, AZ where there is yearly emission test required to register your vehicle. If you do not pass, I think you get one waiver, but are required to go to a mechanic and have your vehicle worked on in order to pass the emissions test.
If I remember correctly, eventually, if your vehicle does not pass, it cannot be registered and subsequently, not allowed on the road.

Next someone is going to tell me that the Feds passed a law about water used to flush crap down a toilet and it screwed up the performance reality of toilets for 15 years before engineering could straighten it out.

VW has allegedly been doing this since at least 2009. If those vehicles weren't going to pass the AZ emissions tests, they would all have been flunking for years and years.
Since there hasn't been a rash of VW failures in AZ, stands to reason that the "cheat" doesn't make the engines grossly out of spec. State standards for a used vehicle are usually lest stringent than Federal standards for new vehicles.
