Any wonder why so many people are scofflaws. Laws should be rare, clear and enforced rigorously.

Freakin amazing. Arresting a man for drinking Ice Tea in public. Throwing him to the ground and handcuffing him for doing nothing wrong.
I hope this man has a team of lawyers and takes them for everything including the Toilet paper in the restrooms.

He should take the deal and consider himself lucky that the SWAT team didn’t show up and shoot him. /s

No doubt there is a problem in Fayetteville with public intoxication, and no doubt they’re attempting to disguise it by mixing drinks in iced tea cans. But, there comes a point when the “solution” is worse than the problem. They have reached that point.

Sounds like a good civil liberties suit. He should file and see if he can get 10k for it.

One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What’s there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced or objectively interpreted – and you create a nation of law-breakers – and then you cash in on guilt

Ayn Rand.

The one thing I dont get about this story is the trespassing charge. If itmwas public lot how could that be a charge? Is something missing here?

*yikes!*..the consequences of buying (HFCS) iced tea in NC..
*yuck!* really never drank the (wrenched/sickly sweet) stuff.
..sounds like the prep (LEO) needs some remedial ed. in cop school or
a blanket party by other ELOs..or he was trying to impress "a working girl."

I drink something called 'Outrageous Ginger Ale.' It didn't occur to me that it looked like a beer bottle until someone at the store thought I was buying beer too early in the morning. To think I actually drank some in the car.

It's just a matter of time before I'm arrested for ginger ale...
by the way - it's great stuff

I had a similar thing happen to me in that frickin state.

Pulled over by not one but 2 N.C. state patrolmen..yanked out of my car demanding that I hand over the beer I was drinking...what they found was a coke which I had been drinking.

One officer had me face down on the ground the other proceeded to empty my luggage and dumped it all over the ground looking for the “beer”

Not finding what they were looking for, they just up and left...no sorry, no let me help you reload your car.

Me...at the time..White, 58, a bit overweight, drive a Cadillac.

This is the same prosecutor who has held Joshua Eisenhauer in prison for over two years without a trial and with no treatment for his severe PTSD after a PTSD flashback where police shot him 4 times while in his home alone after smashing down his door in the middle of the night while he was asleep.

http://www.youtube.com/watch?v=Pvr8SBu0dLg

The same police officer who shot Staff Sgt. Eisenhauer shot and killed another Staff Sgt. in the Warrior Transition Unit at Ft Bragg shortly after shooting Joshua.

This sounds like one of them there bags of absolute, 100%, bull-$hit. Officer Stop-Resisting didn’t have his costume on at the time and wasn’t expecting someone to not obey. Is the property owner pressing the trespassing charge?
