Can this guy/these guys face any kind of sanction/prosecution for attributing quotes to individuals who never said what was quoted? Where does satire cross the line into libel? Don’t get me wrong, I enjoy getting faked out as much as the next guy but sometimes I wonder.
While TRUTH is a defense, Libel has a meaning that is understood to indicate personal and intentional harm. Add to this that 'Public Persons' have a different standard than a non-public person.
How this works is like this, if I claim President Obama is a liar and he then sues me for libel, my defense is the TRUTH, he did lie. If I make a malicious (false) claim against my local mayor that he took a bribe, and he can prove that he did not, he may be able to sue me for libel but he has a more difficult case to make than someone who is not out in public. If I claim that my neighbor is a NAZI Skinhead and I know he has got a full head of hair, he would have an easier time of winning a libel suit against me.
One of the cases that I think should have been brought was when an Ohio government bureaucrat investigated and made public malicious information about Samuel Joseph Wurzelbacher aka "Joe the Plumber" who argued with candidate Obama in the 2008 campaign. At that time he was a private citizen and for his private info to be released to smear his character was, to my mind, quite libelous!
