ObamaCare’s Medicaid Expansion quietly enables states to confiscate assets from dead seniors

The Affordable Care Act was designed to dramatically increase the number of Americans who qualify for Medicaid. In fact, the ACA will literally FORCE many low income seniors onto Medicaid rolls as subsidies for regular ObamaCare plans are NOT available to those over 55 years of age who earn less than 138% of the federal poverty level ($15,856 for individuals; $21,403 for married couples). And without such subsidies, ObamaCare plans are generally far too expensive for older, low-income individuals or couples. (1)

Why should any of this matter to those getting “free” healthcare via Medicaid?

Because: “If you’re 55 or over, Medicaid can come back after you’re dead and bill your estate for ordinary health-care expenses.” (2)

Iirc trust does not protect assets from Medicare.

Only diverging and transferring the assets before the look back period.

I am not saying you should not use all legal means to reduce what the govt may take from you or to put it another way -what you can take from the government.

Then let's not complain about the very wealthy using every loop hole to take from the government OR THE VERY POOR TO TAKE WELFARE, FOOD STAMPS, FREE PHONES ETC FROM THE GOVERNMENT. In other words it GRAP WHAT YOU CAN AND SCREW THE TAXPAYER.

I don't consider recovering costs by attaching assets to be wrong.

What is wrong is getting expensive, free medical care when you have a bundle of assets. Forcing people into Medicaid when they are not poor is also wrong. Medicaid makes you a second class patient not welcome by an increasing number of physicians.

The entire welfare/health care/insurance system is FUBAR. The Federal government needs to completely withdraw with any active participation in these systems, assuming an advisory role only. HHS needs closing permanently. The free market will yield the best health care system at the least cost & greatest convenience.

you are correct ... Medicare is not where the scam originates it is Medicaid ... and with the new law of zer0care ... it all probably become a scam to take money away from the middle class. Wonder if there are Grandfather clauses?

The takeaway here is that we are fiscally doomed. I’m no great fan of letting the government take assets for care that is valued at some arbitrary way. Then again, I’m no great fan of letting the government take care of people when they can take care of themselves.

There are very few actual conservatives left in this country. There are many who think they are, but their actions speak differently.

The best thing for our country at this point is to just go on over the fiscal cliff.

This will cut off all government benefits to everyone. If you get a benefit or a check or both, you get nothing.

Then we will figure this out - it will be painful, it will leave a lot of people hanging out to dry, but there is no avoiding it now.

I’ve been getting static from some federal officials lately regarding the 10th Amendment and some of the State Laws which recognize things different from the feds. To make a long story short ... Am having to threaten some federal officials to make them recognize State Law and the 10th with a law suit in order to make them talk with me. Also, I’m not an attorney.

I’ll agree ... the law at the federal level and the law at the state level are too much different. Adjustment will be painful but History must be repeated again ... so it seems.

According to this post, & I have read it elsewhere, the state can force you into Medicaid if you are below the income threshold, regardless of your assets & over 55.

It say it so plainly in the article. The word FORCE is capitalized.

I know a left winger who has been on medicaid for years. He has money but he hides it. I will laugh if his liberal wife and offspring get screwed when he dies. One of them is constantly worried about her mother spending “her” inheritance.
