Source: SUMMARY OF COLORADO'S NEW GUN CONTROL LAWS.
House Bill 13-1224 prohibits the sale, transfer, or possession of large-capacity ammunition magazines or feeding devices, which includes:1. a fixed or detachable magazine, box, drum, feed strip, or similar device capable of accepting, or that is designed to be readily converted to accept, more than 15 rounds of ammunition . . .
Penalties for simple possession of large-capacity magazines are:
First-time violation is a Class 2 misdemeanor with a $250-$1,000 fine and 3-12 months in prison. Violation after a conviction for a prior violation is a Class 1 misdemeanor with a $500-$5,000 fine and 6-18 months in prison. . .
Regarding transportation:
"Transporters. A person who possesses a large-capacity magazine for the sole purpose of transporting the magazine to an out-of-state entity on behalf of a Colorado manufacturer of such magazines is also exempt from the law."
It doesn't say what the penalty is for someone transporting magazines INTO Colorado, but I guess we'll find that out.
So, what I need to know, among other things, is:
1. What are the relevant Colorado laws regarding concealed and open carry on the Capitol steps in Denver?
2. Can we get a sizable number of armed folks there on a Saturday to conspire with me to violate the law?
My intention is to smuggle in 100 30 round AR or AK magazines and pass them out to the assembled (armed) crowd. ("Here, take one and pass them back.") They ought to disappear like water in the desert. Then, having violated their unconstitutional law in full view of the television cameras, dare the "authorities" to do anything about.
Good luck
Great idea. My only suggestion would be to get 300-400 people so as to overwhelm the police. 100 are not enough.
Now that Colofornia has all those empty cells in their jails that had been reserved for dopers, they are going to have to fill them up with law abiding gun owners exercising their Second Amendment rights.
And this law gets around “Shall not be infringed” how?
If it at all possible, anyone arrested should insist on a jury trial. At the same time they should announce their intention to appeal (on unconstitutionality terms) any guilty decision should that occur. Swamp the courts. Then vote out the libs and rinos.
Please keep me posted on this. I might just join you. If I trade you one of my pmags for yours, then we trade back quickly - several times over and/or with several other people... Who can tell one pmag from another?
Then I read an entry in the blog which made me go "Whoa Nellie"...........this could be the start of something big, here is the blog entry:
"Paul X said...
The penalties are irrelevant, when one has no intention of permitting an arrest.

He is setting himself up for a felony conviction. Conspiracy to commit a misdemeanor is a felony, and he has set down his intention in writing with his name attached. They can arrest him as he pulls up to the scene.
Doesn’t mean I disagree with his opinion, I just hope he recognizes what he’s getting himself into.
Of course if the law in question gets struck down then there was a conspiracy to commit a non-crime.
[[Great idea. My only suggestion would be to get 300-400 people so as to overwhelm the police. 100 are not enough.]]
At which point we’ll have another waco texas on our hands- The govenrment iwll immediately label the group as terrorists, and send in the military to put down the ‘radical right wing extremists’
This is not goign to end well
CO Constitution
Art I, Section 13. Right to bear arms
The right of no person to keep and bear arms in defense of his home, person and property, or in aid of the civil power when thereto legally summoned, shall be called in question; but nothing herein contained shall be construed to justify the practice of carrying concealed weapons.
See post 12.
This seems fair enough, as long as the weapons are for such defense purposes as mentioned. Bringing this stuff onto the capitol grounds from outside wouldn’t count, though. They might want to rethink the form of their protest, which likely won’t create the legally correct challenge.
I mean its currently planned form likely won’t meet...
What the DNC teaches us through illegal immigration and drugs, is that if enough people break a law, it them become s a sought after political bloc,
All my political science professors taught this very fundamental concept.
To change a law, sometimes one must be willing to break that law.
In my lifetime, i have only witnessed the progressives ( communist) practice this philosophy. Abortion, Illegal Immigration, election of Obama, separation of church and state rights. Of course civil rights ( take your pick), Freedom of Marriage Act. Decriminalization of social drug use, etc, etc.
I was talking with our FedEx driver last week. He covers the entire town for everything but the overnight and 2 day packages. He claimed that for over two weeks, every day more than half his truck is filled with Magpul boxes. Every household receives a box under every name in the family. Heh heh.
FWIW my SKS in not an assault weapon.
Those were tightly restricted by the National Firearms Act of 1934.

I do own a Tyranny Response Rifle.
