I disagree. The death penalty and how it manifests does have an effect on crime.

I would love to see the scientific evidence that backs this up. Have often seen the assertion, but never the evidence.

It seems highly unlikely that anyone sets out to do a crime while wondering the consequences. This assigns logic to people who possess almost none of it.
