His lawyers are just doing their job. If they don’t, Hasan gets an appeal based on “incompetent representation.”

You will know we have a problem if the judge GRANTS these requests.

From a Feb. 26th article

Fort Hood gunman Maj. Nisdal Hasan, who recently lost a bid to have the death penalty thrown out in his mass murder case, is now asking that his court martial be held somewhere other than at the central Texas Army post, 1200 WOAI news has learned....

...Osborn also declined to remove the death penalty from consideration, meaning Hasan will not be allowed to plead guilty, something his lawyers had indicated he was prepared to do. Guilty pleas are not allowed to capital crimes under the Uniform Code of Military Justice.

We'll see how this plays out.
