2nd Amendment And The States

At the risk of boring the few regular readers I have accumulated on Political Realities, let me touch once again on the 2nd Amendment and the all-out assault against it that is presently taking place. To be sure, it is a highly charged debate. Many liberals believe no one should have guns, while conservatives believe it is our God-given right to keep and bear arms. And that's not even considering the 2nd Amendment, put into place to protect those rights. Let's review what the 2nd Amendment says, shall we?

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.
2nd AmendmentThe United States Supreme Court has already said that the federal government could not infringe upon that right, but that the states could place reasonable restrictions upon the ownership of guns. That means could have 50 different versions of legislation that either enhances or restricts gun ownership, depending on which state you live in. We have already witnessed history being made as New York Governor Andrew Cumo pushed through a very restrictive gun-control bill. He was so anxious to get it enshrined into law that he forgot to exempt the men and women who are members of the various police departments across the state. Maryland seems to be next in line to restrict gun ownership. Which state will be the first to attempt to ban guns completely?

On the other side of the spectrum, you have states like Oklahoma, Texas, and Arkansas, who not only believe strongly in our 2nd Amendment rights, they have taken steps to protect those rights. I mention those states, not because they are the only states where the 2nd Amendment is cherished, but because I live in Oklahoma and work in Arkansas. And Texas, will everyone knows about Texas. If liberals can celebrate gun control legislation in the states that feel it necessary to pass such restrictive and unnecessary laws, then please allow me to celebrate when states decide it is right and proper to protect the 2nd Amendment and the gun ownership rights of their citizens.

I was watching a video of a 2nd Amendment rally in New York last night and someone was interviewing two women who had come to the rally to support their 2nd Amendment rights. They were asked various questions about how they felt about the 2nd Amendment and if there should be any restrictions placed upon their rights to keep and bear arms. At the end, one of them spoke up and plainly said she was considering moving out of the state, preferably to a state that was more supportive of the 2nd Amendment. That started me thinking even stronger along these lines.

As more and more states begin to draw their lines in the sand, on one side or the other of the 2nd Amendment, is it possible that some states who restrict those rights will see a population decrease? Could it be that many Americans feel so strongly about their 2nd Amendment rights that they will be willing to pack their belongings and move to a state that will be friendlier to the fact that they own guns? It has happened before, when some states have placed such a tax burden on their citizens. Those citizens decided to follow their money and moved to states that were less inclined to tax them to death. I can't help but wonder if some Americans who believe strongly in the 2nd Amendment will not follow the same course.

It is a known fact that states such as Oklahoma, Arkansas, and Texas, as well as a big chunk of the South and some of the West, are much friendlier to the idea of gun ownership by their citizens. I wouldn't be at all surprised to see a sudden population increase as Americans decide to move to where they can feel more like real Americans. And to be honest, I wouldn't blame them for doing just that. In fact, I would welcome them to our state.

What do you think? Is that idea so far-fetched or unreasonable?

If the proposed gun law passes in MA I will be moving to NH. My commute will be horrid but it will be well worth it.

Of course people will leave those states and their populations will drop. Gun control increases crime. Who wants to live and raise a family where the odds of being a victim of crime, especially violent crime, is so much higher...

I moved from Cali to Florida, and CCW/RKBA was a big factor.

The only thing is after liberals really ruin a state with their laws and regulations and then they decide to move elsewhere and continue to vote liberal. Then their new state eventually gets ruined as well. Happened here to Colorado. Many people moved here from California and East Coast like the DC area and now this state is leaning more towards the left. It was totally different when I moved here in 1995.

As the founding fathers wanted. We as a nation was not a centralist Federal gov but a State driven with limited Federal powers. That holds today.

The problem is from Lincoln onward the Federal Gov has pushed more and more on the states. I feel that the States have alot more rights than they are using. Taxes and life style is the main part of each state. Many early supreme court rulings where based on state duties and rights.

Yes we vote on based on our feet. We move to/from counties and states to find the place we fit in. The western states where based on these facts. Texas would not be if it where not the idea of home ownership.

Time to use the left’s tactics and mount up a court case, all the way up to SCOTUS....so as AK, AZ and VT are today, so shall the rest of the country, no?

Use the gay-marriage tactics, incorporation, etc.

Hey Matt. I'm a Floridian as well, and I wondered about your thoughts on Rick Scott and the Florida legislature? Specifically all of the polls run by the various rags around the state showing his popularity ratings in the toilet. I personally have absolutely no problem with the man, and I think he's done a tremendous job running the state. Unlike fake-bake Crist, he's a relatively quiet, out-of-sight Governor, which is how it should be.

I'm concerned, because I feel Florida is on the political cusp. We could very easily swing Left with the election of Dems in 2014, esp. in the Governor's office, and while that's not likely to happen legitimately, if the November elections were any indicator, I think they've perfected voting fraud to the point they might try it at the state levels to start swinging Federal representation to the left.

Also consider the number of transplants from the Northeast and the Left coast who are bringing their limp-wristed views to our state, and I worry we have a recipe for Florida going from red to purple to blue in a matter of just a few years.

Thoughts?

Conservatives and supporters of the 2nd amendment the Obama regime is using the 2nd amendment argument to blame gun owners for its inability to deal with the hundreds of gangland murders and shootings commited in areas under their solid control using illegally obtained firearms.

Obama’s solution to those inner city problems is to remove those rights provided by the constitution to have and bear arms from all US citizens.
None of those 23 so called “reforms” and unconstitutional efforts being edicted by who some call an emperor do not deal with the following issues briefly outlined below .

They won’t because instead of creating a uniformly democratic society where every citizen has an equal voice no matter what their race or ethnicity.

Obama’s policies have divided races and ethnic groups gerrymandering congressional districts where much of this criminal activity occurs. GOPES {goverment of the people (republican party) elites} see this issue as a 3rd rail because most of it is black on black or illegal vs illegal (Mexican) activity .

GOPES are also afraid to say that policy also increased racial tension which has resited in deaths. But again GOPES accept this because of the influence of mainline socialist media which would be accusing them of “racism” if they dare to question it.

The purpose of all this hype on guns is to keep the right and conservatives focused on what the Demo-Coms describe as issues through their propaganda arm known as the MSM (mainline socialist media) not on the problems created by the “Libs” on their road of good intentions or the socialist/fascists/communists successors to comtrol over todays Democrat party; Which is the cost ,waste, and corruption of his administration which had led to a 16 trillion dollar deficit.

Not one word will address or offer a solution about the hundreds of gangland murders and shootings using illegaly obtained mostly handguns and revolvers .Using code words like “assault rifles” which are really single shot per trigger pull semi automatic rifles, used for small game hunting or target practice. That are legal in every state but made to look like their military counterpart..Called AR’s since Viet Nam and a DOD decision ARs are really medium caliber (22.3) machine guns designed to wound not necessarilly kill which is why they are automatic and fire as many rounds that are in its magazine once the trigger is kept in the pulled position. .They replace quick kill 30 caliber semi automatic (single shot) M-1, Springfield rifles and carbines used during WWII and Korea and approved in most states for use in big game hunting.

Obama certainly can’t critique a system created by his ilk .Ignored in his 23 edicts is that when once caught, perps get set free with lenient sentencing from “liberal” judges or sob sister plea bargain prosecution (which Obama supports for when a Illinois state senator while introducing legislation to sentence any 15 year old as an adult, Obama voted “absent” with others on roll call ) promoted by the MSM,The New York Times CNN, NBC and,ABC. There’s certainly no criticism of “no snitch” mentality partcularly in areas where these shootings are rampant.

It would be nice at these rallys if conservatives would point these facts out to Obamas adoring public.

I agree, FL can swing either way depending on a lot of factorss. It really is about the north-south divide in FL. Up here in north FL, it feels a lot more like GA or AL. From Gainesville north is really the South. From Orlando south, it’s something very different.

So insofar as county politics concern the RKBA debate, I’d say it’s a lot better in N FL.

I went to school at FSU and now call the Tampa Bay area my home. I’ve lived here since I was a child, and I’ve seen it go from orange groves to cookie-cutter neighborhoods in just 20 years. I remember my trips to the Wakulla county sinkholes quite fondly. Plenty of lands up there to disappear into.

Perhaps a move will be in my future. Thanks for the response, Matt.

Can anyone point me to the legal history of the “states could place reasonable restrictions” part? Why is the 2nd Amendment different from other civil rights, which the Supreme Court says apply to the States? “Reasonable restrictions” on free speech, press, assembly, religion, exist, but are extremely limited. What are “reasonable restrictions” on the right to keep and bear Arms? No guns for felons and lunatics seems reasonable. Categorical bans on Arms seem self-evidently unreasonable. I presume some poor sap, whose life has been destroyed by unconstitutional state laws such as in NY, must appeal a conviction all the way to the Supreme Court for this to be revealed. Seems just...

Yes, why do people who move to get away from certain policies then vote to enact the very policies they wanted to escape? I don’t get it.
