GOP legally barred from fighting vote fraud

The case is the Democratic National Committee vs. the Republican National Committee, originally from 1982.

Democrats alleged Republicans were trying intimidate minority voters in New Jersey and brought the legal action. The RNC, inexplicably, decided to agree to a consent decree before a Democrat-appointed judge rather than fight the claims.

The judge, Dickinson Debevoise, appointed by Jimmy Carter, later retired but decided he would continue to control the case. The decision requires the RNC – but not the DNC – to “refrain from undertaking any ballot security activities in polling places or election districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately in or directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose.”

The rest of the agreement essentially requires the RNC to follow applicable state and federal election laws.

But the section cited above has been used for decades to warn off Republicans from any challenge to evidence of voter fraud in districts with “racial or ethnic populations.” The law has remained, even though the RNC recently challenged it at the appellate level only to be turned down by Judges Joseph Greenaway Jr., appointed by Bill Clinton; Dolores Sloviter, appointed by Carter; and Walter Stapleton, appointed by Ronald Reagan, in the 3rd U.S. Circuit Court of Appeals.

It now is pending before the U.S. Supreme Court.

But two election veterans both told WND it still is hurting the fight against voter fraud in the United States.

Consent decrees have a horrible way of lingering long past the immediate reason. I worked for a large international corporation subject to a consent decree from the 1920’s that continued to prevent what would have been acceptable business practice for any other company.

True the Vote or another organization is going to have to take the lead, and if we want any progress we will have to help their projects unconnected to the GOP.

I agree that the republican party needs to be left for dead, but have a slightly different thought process to get there.

Republicans and democrats are working together with the effect being a huge bias to re-election for both parties. A political class has solidified power in the US.

Switching parties is part of it (as is being done in NY and has been done in PA and elsewhere), and a clear signal that the ballots are being manipulated through party affiliation. Primary stuffing to split votes is another tactic used to manipulate the ballot. Another tactic used by the DNC is to throw tons of money at a few congressional races, where the incumbent refuses to play ball. (West, Dornan, Bob Barr to name a few.) If they play ball, They run unopposed in the general election.

The two party system is rotten to the core, and the American people are suffering because of it.

Oh, and this whole manufactured crisis of the fiscal cliff...

it was created by passing a law with a poison pill. That poison pill is universally agreed to be rotten for the USA.

The ‘compromise’ will be slightly less rotten, but better than the devastating poison pill. - giving cover to both wings (d and R) of the political ruling class to vote for it.

Summary from debunking the last half-dozen times this court case was brought up the past week:
  1. The consent decree covers the RNC, not the GOP (which includes state and local committees)
  2. The consent decree doesn't ban the RNC from anything. It requires pre-approval for plans.
  3. The consent decree has NEVER stopped the RNC from performaing any voter fraud programs.
  4. The RNC has NEVER submitted a plan for pre-clearance.
  5. The decree explicitly excludes voting-day poll-watching activities and other such programs from the pre-clearance requirements
  6. the decree is about voter registration programs, not post-election voter fraud inquiries.

So, no, this consent decree in no way shows "why" the GOP doesn't stop voter fraud.

WND should stick to mis-understanding the constitution. - The court case has NOTHING to do with stopping the "GOP" from fighting voter fraud

I am wondering if the GOP can be sued, legal action of some kind, to force those who run the organization to take remedial action to at least level the playing field.

The GOP can be concentrating on any number of things but until the voter fraud comes to a screeching halt, we will not win another significant election.

An interesting post and explanation of the situation. I tend to think of the GOP and RNC interchangeably. It has been a wonderment to me since the first Bush election and the vote count chaos that ensued, why the Republicans did not prioritize securing ballot integrity.
Something is rotten in Denmark but party members have been unable to persuade the party leaders to effectively stop the obvious and now institutionalized voter fraud.
Who benefits from this stacked deck besides the democrat party?

We can not wait for 2014 and 2016 to regroup and figure out new strategies. By then it will be too late. The Marxist/Muslim usurper will have completed his planned distruction of America.

Polls indicated that Romney was going to win the election. The economy is close to Great Depression era conditions, and unemployment is almost as high as when Obama entered office. Economic conditions became so dire after Obama took office it prompted the rise of an entire new movement, the Tea Party.
Presidents rarely win reelection when the economy is in the tank.
So how did Romney lose a race that numerous reputable polls and pundits predicted would be an easy win, based on historical patterns?

This explanation, BTW, absolutely reeks. There is no "consent decree" preventing challenges to elections on a local basis.

This is a national disgrace. Fat Albert, Kerry, and Obama benefitted enormously from vote fraud in the so-called "swing states." The 450,000 "ghetto votes" that put the Kenyan Assklown back in public housing were fraudulent as hell until proven otherwise.

Use some logic, GOP! Examine the phenomenon: close to 100% turnout in districts that produced "0" votes for Romney. Every Republican registered in those Democrat-majority districts stayed home?

Not bloody likely. Allow me to put it another way: as likely as that district in FL that reported a 142% turnout. Where, BTW, was the official GOP support for West in his fight? Same place it was for B-1 Bob Dornan, and wannabe Governor Rossi in WA?

This consent decree disallows individual challenges BEFORE voting, not after. After the vote you can challenge to your heart’s content, but as Allen West found out, sometimes it isn’t fair then either.

Good point, Pearl! However, the posters seem to have seized upon it as an excuse of sorts for GOP/RNC apathy or resignation to the status quo of widespread vote fraud that favors the Democrats.

Blame it on Eisenhower refusing to challenge the corrupt election of the whoring Jackanapes.
