Despite a mainstream media blackout on the topic, the alternative media is abuzz with this weeks hearing on the constitutionality of the clearly unconstitutional NDAA. In case you dont remember, section 1021 of the NDAA, which Obama signed into law on December 31 of last year, allows the government to lock up U.S. citizens indefinitely without a trial. At the time of signing, Obama penned a pathetic letter to many of his outraged supporters where he basically said he signed it but he wont use it. Thanks pal!
In any event, the Administration is showing its true colors by appealing an injunction that judge Katherine Forrest issued against it in May. The injunction was in response to the lawsuit filed by Pulitzer Prize winning journalist Chris Hedges and others. While the NDAA clearly vaporizes the 5th and 6th Amendments of the Constitution, I believe the real target is the 1st Amendment. By having a law on the books that allows the government to arbitrarily lock anyone up and throw away the key, the government is actually trying to instill enough fear in people that they self-censor speech and become too afraid to criticize the criminal elite political and economic oligarchy.
Tangerine Bolen is one the lead plaintiffs in the suit against the government and she penned a powerful piece for the UKs Guardian. Here are some key quotes:
I am one of the lead plaintiffs in the civil lawsuit against the National Defense Authorization Act, which gives the president the power to hold any US citizen anywhere for as long as he wants, without charge or trial.
In a May hearing, Judge Katherine Forrest issued an injunction against it; this week, in a final hearing in New York City, US government lawyers asserted even more extreme powers the right to disregard entirely the judge and the law. On Monday 6 August, Obamas lawyers filed an appeal to the injunction a profoundly important development that, as of this writing, has been scarcely reported.
Judge Forrest had ruled for a temporary injunction against an unconstitutional provision in this law, after government attorneys refused to provide assurances to the court that plaintiffs and others would not be indefinitely detained for engaging in first amendment activities. At that time, twice the government has refused to define what it means to be an associated force, and it claimed the right to refrain from offering any clear definition of this term, or clear boundaries of power under this law.
This past weeks hearing was even more terrifying. Government attorneys again, in this hearing, presented no evidence to support their position and brought forth no witnesses. Most incredibly, Obamas attorneys refused to assure the court, when questioned, that the NDAAs section 1021 the provision that permits reporters and others who have not committed crimes to be detained without trial has not been applied by the US government anywhere in the world after Judge Forrests injunction.

I would also take the time to watch this short video from one of the co-counsels on the case as to exactly what the government is arguing in court. Not a word from the mainstream media on the most important court case in American history. One that will decide the fate of a law that will effectively dismantle at least a third of The Bill of Rights.
Please share this with everyone that cares about Liberty and The Republic. Mike

Anyone see this interview on PBS? Chris Hedges was interviewed at length by PBS station Bill Moyer about this trial, and it is shocking if this isnt seeing the MSM light, because the idiots should understand it may apply to all of them. Journalists are in danger!

NDAA
Isn't it curious that reporters are directly impacted by NDAA and yet none are reporting on it? I have a feeling that many would, but for fear of losing their jobs. Still, losing a job is a small price to pay in order to defend Freedom. I've quit jobs for far less and never looked back.
Strange, too, that the media isn't talking about this given that NDAA was passed by the media's favorite boogieman, the GOP controlled Congress.
If anything smells like a conspiracy it's this.
Unconstitutional Detention Ping.
Well until a Republican is elected President. Remember all the important issues that went away when Obama became President
GITMO
War in Iraq
War in Afghanistan (escalated)
Patriot Act
Code Pink
Budget Deficits
High price of Gas
Unemployment
Homeless people
And many more.
The average voter hasn’t heard of the NDAA much less the hearing.
Tangerine just got bumped up to the first boxcar.
Thanks for the ping. This is chilling stuff.
Now under Obama dissent is possibly illegal ?
The lawyer who was interviewed is representing Tea Party groups.
Since Jan the man and DOD has named us domestic terrorists and the DOD is planning a war to fight against us in 2016...
What a mess. Our government needs to be nuetered badly.
Isn’t it curious that reporters are directly impacted by NDAA and yet none are reporting on it?
Not curious if you consider we are practically living in a police state.
Saw the movie “Valkyrie” a couple of weeks ago and last night caught “The Desert Fox: The Story of Rommel” on AMC. Because he was found out to be actively involved in treason against Hitler in 1944, Rommel was forced to commit suicide quietly to avoid anything happening to his son and wife.
I fear that a 2nd Obama term would usher in similar conditions that existed during the Third Reich, which is how they controlled the population through fear, intimidation and execution.
When you add the NDAA to this:
“The DHS/Office of Intelligence and Analysis (I&A) has no specific information that domestic rightwing* terrorists are currently planning acts of violence, but rightwing extremists may be gaining new recruits by playing on their fears about several emergent issues. The economic downturn and the election of the first African American president present unique drivers for rightwing radicalization and recruitment.”
(From the 2009 DHS report titled “Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment”. Remember the hubaloo ?)

We could all have a very serious problem.

Anyway, I got dibs to a spot near the window of the cattle car and I also call the top bunk at the FEMA camp. To any future cellmates I may have out there, please accept my apologies in advance. I snore and I’m not a morning person.
Think I’m kidding ? From the US Army:
***
“Military police conduct I/R operations during offensive, defensive, stability, or civil support operations. I/R operations include military police support to U.S. military prisoner and detainee operations within operational environments (OEs), ranging from major combat operations to humanitarian-assistance missions in support of ahost nation (HN) or civil agency. I/R operations are a major subordinate Army tactical task under thesustainment warfighting function. (See FM 7-15.) Placement under the sustainment warfighting function doesnot mean that I/R operations do not have relevance in the other warfighting functions. While I/R is listed under the sustainment warfighting function, it should be noted this is not a specified or implied mission of allsustainment units or commands. Most sustainment units provide logistics, personnel services, and health service support to I/R operations.”

Assuming this document is legit, (I haven’t been able to authenticate it, so I never posted about it. It could be a phony or a RED herring from the Feds, or another one of Cass Sunstein’s attempts to create paranoia. Take from it what you will.) This could very well get hairy for all of us, especially those us with a big mouth, like me.
“I fear that a 2nd Obama term would usher in similar conditions that existed during the Third Reich, which is how they controlled the population through fear, intimidation and execution.”
You’re a 1000% correct, but I have a funny feeling it isn’t going to matter who’s in the White Hut, this law will be used and abused by the next hack who gets more votes than the other hack. You can bet your bottom dollar that this law will be used to silence dissent. Maybe not now, maybe five years, ten years, or even twenty years down the road, we’re all going to have a serious problem. No American government should EVER have this kind of power.
“Our government needs to be neutered badly.”
By whom ?
CONgress has become an utter joke, it went from being the greatest delibrative body ever divised by man, to Babylon on the Potomac. The Executive Branch is more powerful than ever, and the vast majority of the federal bureaucracy is no longer affected by elecions. Let’s face it, the Supreme Court stopped functioning properly in 1913, so We the People can’t count on them any more.
We live in frightening times, indeed.
