Washington (CNN) -- The White House and the Justice Department made clear Friday what had been expected all along: Attorney General Eric Holder will not face criminal prosecution under the contempt of Congress citation passed by the U.S. House.

Legal experts noted this week in the runup to Thursday's House vote that President Barack Obama's assertion of executive privilege in the case would prevent a criminal prosecution under a practice dating to the Reagan administration.

The House also cited Holder for civil contempt to give it the option of filing a lawsuit compelling Holder to turn over documents sought by Oversight Committee investigators linked to the failed Operation Fast and Furious weapons crackdown. Such a case was expected to take years to complete.

A letter Friday from the Justice Department to House Oversight Committee Chairman Darrell Issa, who led the investigation that brought the contempt charge against Holder, explained that "across administrations of both political parties, the longstanding position of the Department of Justice has been and remains that we will not prosecute" in such a circumstance.

Replace Barack H Obama with Richard M Nixon, Eric H Holder with John N Mitchell and Fast & Furious with the Watergate Break-in.

Then imagine the "watchdog new media" presenting this report in such an arm's length & non judgmental manner. Imagine them presenting Ron Ziegler's comments so thoroughly and without response.

I hate these bastards.

keep in mind this is the same government that spent four years and the resources of hundreds of agents investigating baseball.

Now they can’t find one agent to prosecute actual crimes.

Is there any doubt that America is now a full fledged communists Nation. We have no laws for corruption and criminals. Getting real tired of conservatives wagging their tongues and nothing is ever done and cannot do anything with the communists running things.

Being held in contempt, the House of Representatives can request that the U.S. Attorney General's office convene a Grand Jury to decide if Eric Holder should be prosecuted.

But the Grand Jury cannot convene because Obama has invoked Executive Privilege.

Asking the U.S. Attorney General's office to prosecute the boss and Obama's Executive Privilege....Cute huh?

He should be fired...along with Barack Hussein Obama.

If Holder was Roger Clemens or Barry Bonds, the screaming Furies of "The Law" would hunt him ceaselessly till he died.

To Hades with The Law and the overpaid "just following orders" enforcers who make its insane pronouncements possible.

No worries, that is why they included civil contempt along with criminal contempt. They knew that they would not be able to get the district attorney to place charges against Holder. Bush actually did the same thing. So now they will go the route of the civil contempt.

They also still have the option of arresting him which I’ve heard has not been done by the House for decades, but it is still an option!

Don’t give up hope yet! They will get the goods. Issa is determined and he has some democrats backing him up as well.
