This Executive Order was posted on the WhiteHouse.gov web site on Friday, March 16, 2012, under the name National Defense Resources Preparedness. In a nutshell, it's the blueprint for Peacetime Martial Law and it gives the president the power to take just about anything deemed necessary for "National Defense", whatever they decide that is. It's peacetime, because as the title of the order says, it's for "Preparedness". A copy of the entire order follows the end of this story.
Under this order the heads of these cabinet level positions; Agriculture, Energy, Health and Human Services, Transportation, Defense and Commerce can take food, livestock, fertilizer, farm equipment, all forms of energy, water resources, all forms of civil transporation (meaning any vehicles, boats, planes), and any other materials, including construction materials from wherever they are available. This is probably why the government has been visiting farms with GPS devices, so they know exactly where to go when they turn this one on.
Specifically, the government is allowed to allocate materials, services, and facilities as deemed necessary or appropriate. They decide what necessary or appropriate means.

Let’s not forget that the Constitution is a compact between the states. The federal govt that it creates is a derivative of their existence, not the other way around, and comes from limited and certain powers ceded by the States in order to form a Union that allow us to function as a nation.
If we fought the Civil War in part to make the point that states cannot leave this constitutional Union through secession, I would say that the opposite is also true. That is, the federal govt cannot divorce the Union from us and end our Constitutional govt. Only the States can do that through a constitutional convention.
Unless elected in November, on January 21, 2013, President Obama is no longer President. The office is vacant. Should he attempt to hold that seat of power, his claim to such is illegal and nonexistent, and he a unlawful usurper. No citizen, bureaucrat, public official, or member of the armed forces has any obligation to follow him or execute his directives.
Anyone who does so would at best be considered a foreign invading power, and at worst a domestic terrorist who should be afforded no protections. Anyone would be within their rights to shoot that person on sight, without trial, and with extreme prejudice, pure and simple.
So if Zero wants to go down this road, let him. We’ll see how long he can hold it together with over 300 million guns in this country.
Noone can be forced to give up their property based on this order.

Executive orders only apply to federal employees. Noone can be forced to give up their property based on this order.

About 30 days ago a women from the department of ecology stopped by my home (I have a small 10 acre plot)and asked to gps the location of my well. I told her that the location was in the well log filed at the county. her response was that that was not accurate enough. She told me that all the wells in my area were being relocated. as a follow up I asked most of my neighbors if they had received the same visit none had. most wells in my area produce five to 10 gpm, my well produces 50 gpm plus (they couldn't pump it dry during the test) with this ex order I am very nervous about the real reason for the visit.

Well, yeah, Kelo, you are right. The 5th has been gone for a while, but at least in Kelo, they gave some money to the poor bastards who lost their homes. The 5th is also meaningless in all the environmental regulations that amount to a taking of private property, not to mention labor regulations.

So what happened...did you get her to go away or did you let her do what she wanted? This is private property and you did nothing wrong...she has no right to be on your property...does she?
Was that a state department or Federal? Sounds like your problem is with your state.
Our property has a natural year-round spring that flows strongly out of a hillside. A pipe was installed over 40 years ago and at one time, everyone in the area would stop and ask if they could fill water bottles from it. Not so many, now, though or for the past 10 years or so. We have another 3 springs, one of which dries up in the heat of the summer, the other is w/in the 25’ exclusion zone of a National Trout Stream and so, cannot be used, although back about the turn of the century, a ram pump and cachement were installed there.
I just checked and you are in Washington State. This is the place that says you have no right to rain water that falls on your buildings, right? Does your State government have the right to *relocate* your private well? How do they justify that in a water-rich area?
