Georgia is still under the jurisdiction of the DoJ per the Voting Rights Act. The appeal will be based on the state of Georgia denying the minority voters of georgia an opportunity to vote for the candidate of their choice. Evidence will be presented citing the %age of minority votes Obama received in 08. An appeal to the 11th Circuit based on the Voting Rights Act will not be dismissed out of hand without briefs and oral arguments.

It will be difficult to use the VRA because Obama was already on the ballots in 2008. It will also be extremely difficult to use the VRA because Obama chose to ignore the court while thumbing his nose at the authority of the state.

The "I'm black so you HAVE to leave me on the ballot" argument may work temporarily. However, the Supreme Court will have to eventually weigh in, and at this point they may deem the VRA to not apply in this case, or any other with regards to eligibility. That would open up an even Bigger can of worms for the Democrats.
