A U.S. district judge, today, Sept. 13, declared that Congress exceeded its authority under the Constitution when it required all Americans to buy health insurance under Patient Protection and Affordable Care Act i.e. ObamaCare.
Christopher C. Conner who sits in Harrisburg and on the United States District Court for the Middle District of Pennsylvania said The federal government is one of limited enumerated powers, and Congresss efforts to remedy the ailing health care and health insurance markets must fit squarely within the boundaries of those powers.
Conner made the ruling on behalf of Barbara and Gregory Bachman of Etters, York County who had filed suit challenging the individual mandate.

IIRC, in cases where courts have ruled that the filer has no standing in the matter, they have said that Obamacare’s mandate must be implemented before anyone can claim to have a valid cause of action against it.
I don’t know the details, but this was filed by - not a state or group of states, but by individuals. This particular judge took the cause even though Obamacare’s mandate has not yet been implemented.
The thing I’ve wondered is, when is someone going to wake up that this is being implemented in stages, and one of the things happening is that insurance companies and employers are being forced to change their actions under the iron fist of HHS. They have become pawns of Obamacare even while some judges are claiming that the mandate hasn’t been implemented.
Oh, yeah?
If you are being ordered around and you are in their crosshairs right now, you are suffering from this mandate. Because only if the mandate is upheld can Obamacare in its other aspects be implemented and forced.
To claim no suffering until the mandate goes into effect is braindead and blind.
It was gutsy on his part and is kind of a big deal.
