Tom Petty won't back Michele Bachmann's use of 'American Girl'

Among the many traditions for presidential candidates on the campaign trail are kissing babies and getting kiss-offs from rock musicians over unwanted use of their songs. A day into her campaign for the White House, Michele Bachmann is already facing the latter custom.

Tom Petty has sent the Minnesota congresswoman a cease-and-desist order after she used his 1977 classic "American Girl" as background music at her kickoff rally Monday in Waterloo, Iowa, a source close to the singer has confirmed.

This is not the first time Petty has sent out such an order: George W. Bush's team also received one in 2000 when the future president used "I Won't Back Down" at campaign stops. Nor is it the first time a candidate has used "American Girl:" Hillary Clinton also spun it at many of her presidential campaign rallies in 2008, without any complaint from the Rock and Roll Hall of Famer -- who is otherwise relatively apolitical in his music and public life.

Chrissie Hynde is still not too happy about “back in Ohio” but no matter how she feels about it, when people hear that thumping open, they don’t think “the Pretenders” do they? They think Rush Limbaugh.

Well, as a bass player I love to play that song. But yeah, it basically sucks. I’ve never, frankly, seen the draw of that guy. He sounds like Bob Dylan after two weeks of singing lessons.

Nice idea though— some of them could be revived with modern lyrics as applied through our Constitution.

I checked. If the publisher has been paid the usual fee for a public performance then the Bachmann campaign does have a legal right to use the Tom Petty song. Mr. Petty can object on the basis that he doesn't subscribe to Bachmann's politics (and hope she respects his wishes) but he apparently has no legal right to stop her from using his song, assumming the publisher has been paid a performance fee. So, I stand corrected. I also learned something about music copyright law.

I think 'CaspersGhost' (in post #31) has a point: conservative politicians should stay with American country music and not have to put up with some ancient, drug-addled rocker whining about them using it.

Forget Tom Petty.

Michelle Bachmann's objective is the White House, so perhaps her theme song should by The Little White House by Howard Lanin. Waring's Pennsylvanians have a better recording, but it's not on Youtube.

But to get to the White House, she needs to break away from the pack of also-rans, so an appropriate theme song would be Breakaway by George Olsen's Music. I would vote for her just for choosing one or both of these tunes.
