You called a “Stalinist tactic” quite correctly.

However, buckshot will not reliable penetrate a decent vest. And, not only will surprise be on their side, there will be several of them.

May I suggest getting together with other Conservatives and having your legislature pass laws specifically forbidding the search tactics you want made illegal.

Then your State Supreme Court can do nothing and SCOTUS will not be able to intervene either.

I guess you didnt read the Indiana Supreme court decision...you cannot stop any unlawful search by police...so a law would be useless....

The Supreme court can rule the new law Unconstitutional, and continue on as before. The legislature will give them cover, as will the media...they always do.

Section 11. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable search or seizure, shall not be violated; and no warrant shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the person or thing to be seized.

What part of this is unclear? So we need a law for the law?

What happens when they search your house? Once they are in the door it is over. Any thing they perceive as a threat can and will be confiscated whether it is under lock and key or not. Do you really think that they are not going to ransack your house ‘conducting a search?’ What about the lovely family dog who perceives them as a threat being shot dead due to an unlawful entry search and seizure activity?

This ruling needs to get overturned like...yesterday. This ruling truly had little to do with the case at hand that had probable cause, after the officers were called to home.

Nope, it won't.

When a deputy around these parts started wearing a vest to serve papers to people, a friend said "Good God, K-----, You're just going to force them to go for the head shot!".

I hope the folks in that Sheriff's jurisdiction have the ability to petition for a recall election to get him out of office quickly, and the gumption to do so.
