I don’t know if I’d read that much into the quoted phrases. Any operational plan put out by a government agency reporting to the executive branch is going to naturally state that the plan is there to support the objectives of the executive branch. I mean, what else are they going to say? Somehow, “despite being in disaccord with the Attorney General and the President” doesn’t seem to be likely, does it?

So, by itself, it really doesn’t seem to me to implicate anyone higher than the specific office who wrote it, or a higher office if there’s a supervisory approval noted. That is, it’s Mark Chait who bears responsibility for this, unless it can be shown that Holder and/or Obama knew about the specific policies.

We now know that after continued urging from the ATF to sell weapons to straw purchasers, one licensed gun dealer communicated to ATF supervisor David Voth that he didn’t want to sell weapons to bad guys because he has “very close friends who are U.S. Border Agents.” He was directed to continue. Brian Terry was killed six months later.

There is no legal way to order a business to do business they know is illegal. The ATF had to be using the blackmail intimidation of threats to put these dealers out of business and/or prosecute them on trumped up charges. There are some Federal felonies right there.
