Palins Move to Trademark Their Names

In the last several months, Politics Daily has learned that the Palin family lawyer, Alaska attorney Thomas Van Flein, has filed applications to the United States Patent and Trademark Office to trademark “Sarah Palin®” and “Bristol Palin®.”

According to patent office application (serial # 85170226), Van Flein registered for a trademark of “Sarah Palin” on Nov. 5, 2010 — three days after the midterm elections. The government trademark examining attorney has “found no conflicting marks that would bar registration.” In other words, nobody else had already taken the proposed trademark. A “Bristol Palin” application (serial #85130638) was filed on Sept. 15, 2010. Bristol Palin’s stint with “Dancing With the Stars” premiered on Sept. 20.

Celebrities often trademark their names to protect their image or brand from others who might try to cash in on their likeness or use their name in an inappropriate way.

According to the United States Patent and Trademark Office website, the Palin applications are still active, but not without problems.

For Sarah Palin’s application, there are two classes of commercial service for which her name would be a registered trademark. One is for “information about political elections” and “providing a website featuring information about political issues.” The second is for “educational and entertainment services … providing motivational speaking services in the field of politics, culture, business and values.”

Went to the story — it looks like a bunch of prosaic technicalities in the application need to get cleared up, nothing the Palins can’t address.

She might be broadening her options, as in Sarah Palin brand political consultation services in the event she does not make it to a new political office. Given the low down things that liberals have done to her in the past, she is wise to set up safeguards.

Trademarks are pigeonholed into one of a myriad of categories (over a hundred IIRC). An application has to state the category or categories desired, and the fee and paperwork submitted for each category opted into. Someone might still be able to market a Sarah Palin video game if she doesn’t apply for that category, for instance.

Very smart move by a very smart family.

With the copywrite of “Sarah Palin,” Sarah name will be protected against anyone who writes negative things about her or anyone that prints signs or bumperstickers opposing Sarah.

If they didn’t include class 25, the t-shirt, cap, etc. (clothing in general) goods are still free for all. Same goes for classes 9 (electronic media) and 16 (printed matter - from books to bumper stickers). I wonder why?

So, would she have a little ‘TM’ next to her name on campaign signs?

If someone did attack ads against her, would they have to ask for permission or pay royalties? LOL

This could be a wise move on their part.

Nope, you can't copyright a name. You can register it as a trademark, which Palin is doing, but only to protect its use in a business; you can't prevent people from "writing negative things" about a public figure, or "printing signs or bumperstickers opposing" them. We do still have a First Amendment.

Well, in her defense no one has ever been attacked as viciously as her in US politics. In case you find the previous statement questionable I give you two words: 1. Trig. 2. Tucson.

So why not fight back against the scumbags trying to cash in while they sneer and snipe at your family? You know the types, would sell their own mother kind of douchebags. Sarah is a fighter.

Palin/Bachmann Lock down the female vote and run away with the election.
