Wiki many not summarize this political publicity stunt because it was not a “bill,” but a resolution, which has no force of law. It was preceded by a “Bill” - SB.2678 - in February 2008 also addressing McCain's ineligibility. McCain's eligibility is very much in question. No clarification by the Court has every occurred as to the children of military citizens. The McCaskill/Obama Bill, the ‘‘Children of Military Families Natural Born Citizen Act’’ didn't pass. It could have no effect in any case. It is political agitprop.

There are varying opinions about McCain's legitimacy. The thorough analysis by Professor Gabriel Chin points out that McCain was also, by a quirk of fate, not born on territory over which the U.S. had sovereign jurisdiction. The Supreme Court would need to extend the definition beyond Chief Justice Marshall's “born on the soil of citizen parents,” which was confirmed by Chief Justice Waite, Justice Gray, Chief Justice Hughes, and by 14th Amendment originator, Congressman and Judge John Bingham.

This Supreme Court has shown that it is controlled by forces which supersede the Constitution. It may also be that only an amendment will extend Article II to include overseas-born children of military citizens. Currently, this only pertains to Obama to the extent that McCain's uncertain legitimacy silenced whatever legislators might still put their Constitution and country ahead of political ambitions. Only Congressman Nathan Deal had the courage to ask for proof of eligibility, and he was immediately dealt ethics charges. You can bet he would have been treated more like Scooter Libby than Charlie Rangel. Investigators dug through old tax documents and found some questions they could ask about tax deductions allowed a family auto salvage yard - peanuts! Deal resigned and is now Governor of Georgia, never having received an answer to his questions about Obama’s eligibility.

For another discussion, our Framers, especially Washington and John Jay, had already prevented foreign-born revolutionary soldiers from becoming field grade officers. Ascertaining the allegiance of a potential president argued more for a conservative choice. Being president is not a privilege. It is a constraint designed to insure allegiance to our nation of laws. Look at Dr. Lakin, and the simple fact that the military can be controlled by political forces which have superseded the Constitution, which officers have presumably all sworn to defend and protect.
