I understand what you are saying from a logistics point, but not from a legal point of view. When you buy an airline ticket, does the contract specifically you are waiving your Constitutional Rights? I haven't bought a ticket lately, but I doubt it informs you that you are waiving your Constitution Right prohibiting “unreasonable search”
You maybe giving permission to reasonable search, but that does not include groping and the “nudie scan”.
If the contract does say you are giving up your Constitutional Rights in order to exercise your Constitutional Right to travel freely, then I think a good argument can be made that this is Unconstitutional on its face.
We need some good legal advice on this whole thing.
Of course ACLU silence is deafening.
