Yes, I understand that some in this country do not believe in Property Rights and that lack of understanding of Property Rights has lead to the horrific Kelo Decision as well federal confiscatory tax policies.

However, I will stand with the Constitution and our Founding Fathers who understood the Right to Property.

As long as you own the lawn and you own the cross, you are free to set it aflame.

However, if someone decides to burn a cross in my front lawn they will be going to jail or to the morgue.

The 14th Amendment states that citizens cannot be deprived of property and that being the case, I don't see how a government can deny the owners of the property in questions the right to do what they wish with said property.

"No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

There are limits. For example, in WWII, a private property owner probably would have had a hard time building a Nazi recruitment and victory celebration center in the heart of NYC. This is a different war, but the exact same thing.

The Constitution is clear on Property Rights and it is also clear that every citizen has a right to the property that they own.

But don’t blame me as I was not one of the framers of the Constitution.

Hopefully you understand conservatism better than you understand property law.

Local ordinances and zoning boards have the power to control the building process. As a big supporter of the Constitution Im sure you agree with Palin’s right to attempt to direct that political process with her rights to free speech.

Show me where property right are described as sancrosanct in the Constitution?

Then write an essay on property rights and the political process. This would be a good way for you to actually learn something about property rights also being shifted by the political process...see eminent domain, zoning ordinances, etc.

Umm no. You have no idea what you are talking about. If you live in a city, town, township, village, or some other form of municipal government...it is more than likely that you lived under local fire and safety ordinances that would make it very illegal to do this...even on your own property.

Really, here is an example of but one restriction actually placed on owners of property...there are about 14 more in this example.

“Section 11. No junk vehicle, house trailer, or commercial vehicles, such as, but not limited to, moving vans, trucks, tractors, trailers, wreckers, hearses, compressors, concrete mixers or buses, shall be kept on any Lot. No storage of boats, boating equipment, travel trailers camping equipment, or recreational vehicles shall be visible from the street. The location and design of enclosures for boating, camping, traveling (other than automobiles) and related equipment shall be approved by the Architectural Control Committee as required under Paragraph 9 herein. No metal garage shall be erected on any Lot. “

If one were to read the entire 14th Amendment, the would find that the laws restrictions etc must be applied fairly under the Equal Protection Clause.

Therefore, governments cannot restrict one property owner from building what they want on their property and permit another property owner within the same jurisdiction to build a structure of the same class on their property.

That would all depend on the jurisdiction and their rules and regulations regarding burning of materials on one’s property.

And while I can show you jurisdictions where one could burn a cross on their own land, you could not show me a jurisdiction where one, without the consent of the land owner, could burn a cross on property that they do not own.

Every Section and every amendment in the Constitution is sacrosanct.

I doubt seriously that a citizen asked for this. Almost all imams and mosques are run by alien enemy agents, fomenting death to America and teaching radical islam to all that will listen. IF America would ban islam like it will eventually have to do... and we will either fall or fight because there has never been a compromise with islam that lasted, then there would be no evil doers in America to worry about. Remember the CRUSADES and learn. We are at war... rules change when you are trying to win... WWII saw many changes and after we won... rights were restored. Thank GOD that YOU do not get to decide. No worries... you will most likely get YOUR way... YOUR president is a muslim and no one will be allowed to stop the islamic desecration of the hallowed ground at the Twin Towers site.

But when Obama, not knowing a thing about an issue, immediately goes on record against something (the Gates arrest, for instance), and makes a complete fool of himself... not a peep out of you lefties.
