They likely are claiming CO2 is a pollutant and will need to install outrageously expensive CO2 removal equipment. Don’t be surprised if this article is right and 1/3 of the refiners will be shut down or punished severly.

Part of his strategy to force “Cap and Trade” through. Shutdown the refining capacity so the price of gas goes through the roof, and then force “Cap and Trade” down our throats.

But none of that has given pause to Occidental or the politician who helped engineer the sale of the drilling rights to the federally-owned Elk Hills. That politician is Al Gore.

Gore recommended that the Elk Hills be sold as part of his 1995 “Reinventing Government” National Performance Review program. Gore-confidant (and former campaign manager) Tony Cohelo served on the board of directors of the private company hired to assess the sale’s environmental consequences. The sale was a windfall for Oxy. Within weeks of the announced purchase Occidental stock rose ten percent.

That was good news for Gore. Despite controversy over Dick Cheney’s plans to keep stock options if elected, most Americans don’t know that we already have a vice president with oil company stocks. Before the Elk Hills sale, Al Gore controlled between $250,000-$500,000 of Occidental stock (he is executor of a trust that he says goes only to his mother, but will revert to him upon her death). After the sale, Gore began disclosing between $500,000 and $1 million of his significantly more valuable stock.

Nowhere is Al Gore’s environmental hypocrisy more glaring than when it comes to his relationship with Occidental. While on the one hand talking tough about his “big oil” opponents and waxing poetic about indigenous peoples in his 1992 book “Earth in the Balance,” the Elk Hills sale and other deals show that money has always been more important to Al Gore than ideals.

I wonder how long it will be before the price of gas reflects all this. Right now it doesn’t seem to be much affected (at least in my neighborhood.)

TCEQ is the state agency that administers EPA regs in Texas as do other state agencies around the nation.

Texas uses a flex permit program which caps total emissions from a facility for a range of pollutants from various point sources and keeps those total emissions beneath a cap. It sounds as if the EPA wants to monitor these various points (which can be numerous in any given facility) on an ongoing basis to ensure that emissions from any given point don’t temporarily spike leading to short term concentrations.

TCEQ has proposed changes to their program which by statute must pass a rergulatory review process which includes a 30 day open comment period which I believe would close on August 2. TCEQ has stated they don’t believe the EPA has taken their proposed changes into consideration. TCEQ also claims they already meet EPA clean air regs and the proposed changes are being made only to pacify a belligerent EPA.

At a minimunm this will raise operating costs and reduce plant flexibility for these large and very complex petrochemical plants and refiners. The EPA has already assumed control of the permitting process for three plants in Texas and I’m betting there will be more to follow.

Depending on how aggressive the EPA gets this thing has the potential to get really nasty. This is an area where it appears Perry is willing to draw a line in the sand (at least until elections) as he feels there’s real political hay to be made. Beyond November I have no idea if he continues the hard line.

Yeah, I just don't think I'd agree with that. Despite the protestations that the "world is ending", due process - at least for now - continues to endure.

Barack Obama directed his subordinate to issue an administrative edict to shut down drilling of the country's coastline. Low and behold, that administrative decision was appealed to the judiciary, as is appropriate. And, not surprisingly, that administrative ruling failed on the merits and an injunction was issued; Due process at work.

I'm not a reactionary catastrophist. It's why I don't believe in Global Warming, and it's why I don't think the Republic is coming to a halt because we have a leftist in office. We survived Jimmy Carter, we'll survive Barack Obama, probably.

Saying it another way, HOW STUPID can Americans be? It is long past time to start impeachment hearings. The DUMBY Congress will not do it until we start hitting the streets which is exactly what Obama wants.

November will be interesting, especially if Obama declares Amnesty and allows everyone to vote and vote often.

Due process worked in this case only because a single judge did the right thing - a rather flimsy hook on which to hang an argument, in my opinion.

Obama’s officials did what Obama wanted them to do. That is the power of a monocracy. I would be saying this regardless of the political bent of the occupant of the White House. This one is just scarier because he REALLY believes that the Constitution should be replaced, making his oath-taking adequate cause for impeachment. Living as close to the Federal Disaster Zone as I do, I also understand that this would never happen, even with an overwhelming repulican congress.

Not at all, in fact almost always that's EXACTLY how due process works. This decision reinforces that there are three co-equal branches of government. In our system of government, a single judge can outflank the sitting President, if that President behaves in a manner that is inconsistent with Constitutional principles

I'm sure when George Bush outlawed (by Executive Order) the financing of stem cell research with Federal money, the liberals were pissed. But, they lost that election and these are the kinds of things you get pissed about when you lose elections.

Right, they did what Obama wanted because Obama's the boss. We live in a Republican form of government where elected officials set policy, not life long bureaucrats. They (the bureaucrats) follow policy set by the Executive.

Elections have consequences. We lost, they won. It's logical to presume that most of the policy decisions this administration makes, conservatives won't agree with.

Some conservatives sat home in Nov of 2008 because they couldn't stand John McCain. I didn't primarily because I understood the downside of a liberal Executive in partnership with a overwhelmingly liberal Congress. They didn't (and, I'm not implying you were one of those that stayed home). The upside to Obama is that liberals get exposed as the danger they are, and hopefully spiteful conservatives have learned their lesson - there are things worse than RINOS.

“President Obama’s EPA has decided to mess with Texas, and they may be doing it on Bill White’s behalf. News broke on Wednesday that the EPA is rejecting Texas’ flexible permit system, a system that been in place for 16 years, has enjoyed bipartisan support, and has actually worked to reduce NOX emissions in Texas better than the EPA’s own programs work in other states. Gov. Perry, Lt. Gov. Dewhurst, Attorney General Abbott, and indeed all of the Republican leadership in Texas are outraged by the EPA’s actions.

As usual, there’s more to the story. The Democrats’ nominee for governor, Bill White, is right in the middle of the EPA’s extreme and unnecessary move. According to an editorial by the Houston Chronicle, White met with EPA regional director Al Armendariz last fall, and that meeting apparently spurred the EPA’s drive to attack Texas.

Mayor White has also been critical of the Texas Commission on Environmental Quality as being too lax in enforcing state laws against polluters.....

After meeting with White, EPA officials announced that many of the TCEQ rules are in violation of the federal Clean Air Act.

Did the Democrat who wants to be Texas’ governor collude with the Obama EPA to hit Texas hard, putting Texas families and businesses at risk in the process, so he can play politics and blame it all on Gov. Rick Perry? Whatever one wants to call that, it certainly isn’t putting Texans first. Bill White needs to answer for this assault on our state.

As this move builds on the EPA’s decision to regulate CO2 without Congressional input, we seem to be looking at an agency that the Obama administration is using to command and control the US economy to further its far left statist agenda. The Obama administration wants to control everything - private industry, health care, everything - as part of President Obama’s campaign promise to “fundamentally transform America.” Even more appalling, these power grabs come at us while the Democrats in the White House and Congress show rank incompetence in their existing duties of securing the border and dealing with the oil spill that occurred in federal waters. And despite his recent rhetorical attempts to distance himself from his masters in the Democratic Party, Bill White is obviously arm in arm with them the whole way.”

Thank you for posting this, if refineries were being shut down in Texas I think I would have heard about it before seeing it here. Plus, people down here in the oil industry would be in an uproar about it. I have heard about upgrading their plants which will cost them and may lead to a loss of some jobs in the future.

The point I was trying to make (apparently not in the clearest manner) was that the judge who ruled against the President should never have had to make his decision because the President should never assumed he had the power to issue unilateral decrees.

No, I did not sit out the last general election. I vote. I just no longer pretend that doing so will turn America back into America.
