Homeschoolers alarmed by Kagan nomination [Push for international law worries parents-rights group]

Supreme Court nominee Elena Kagan's press for considering international law as "the context" for interpreting U.S. law has incited worries her appointment could pave the way for world treaties that threaten both parental rights and homeschooling in the United States.

She needs to be defeated on this basis ALONE... but I am sure there is more reasons to oppose this nomination.

Specifically, the HSLDA is concerned Kagan may push the Supreme Court to consider a pair of United Nations treaties – the Convention on the Rights of the Child and the Convention on the Elimination of all Forms of Discrimination Against Women – as relevant to cases in the U.S.


This is bad news folks.. very bad.. if you are not familiar with these treaties you really need to wake up..

45. Repeal the Connally reservation so the United States cannot prevent the World Court from seizing jurisdiction [over domestic problems. Give the World Court jurisdiction] over nations and individuals alike.

very scary stuff indeed... I talk to so many people who are emotionally wrapped up in the thinking that “kids deserve international protection” or “what’s wrong with keeping kids safe” etc..etc... they really don’t think about what is really at the core of that thinking.. scarry... very scarry indeed..

Are there any Republicans in the Senate with the courage to blue slip Kagan and force Obama to give her a recess appointment? At least that way, her appointment would last until January 2011 and if the Senate has enough Republicans by then, she might NEVER be confirmed.

I have not been following the nomination process as closely as I should be... I am currently on Active Duty as an instructor and the U.S. Army Drill Sergeant School.. my days are a bit long.. in fact I gotta get off FR and get back to work... I hope my fellow FReepers can answer this question..

Kids deserve an education by any means the parents deem necesary.

Also read into the congressional record from the stated communist goals in 1963.

41. Emphasize the need to raise children away from the negative influence of parents. Attribute prejudices, mental blocks and retarding of children to suppressive influence of parents.

17. Get control of the schools. Use them as transmission belts for socialism and current Communist propaganda. Soften the curriculum. Get control of teachers’ associations. Put the party line in textbooks.

Here's a couple of things that should give anyone pause in her selection.

"In a 1996 paper, "Private Speech, Public Purpose: The Role of Governmental Motive in First Amendment Doctrine," Kagan argued it may be proper to suppress speech because it is offensive to society or to the government."

Kagan: Some speech can be 'disappeared'

A couple of questions need to be asked of her. Who decides what is offensive? And what measures should be taken to "suppress" offensive speech? If she says something that society or the Government finds offensive, what measures will she agree with to "suppress" her comments?

"WND has reported that in her undergraduate thesis at Princeton, Kagan lamented the decline of socialism in the country as "sad" for those who still hope to "change America."

Obama's Supreme pick has love affair with socialism

She should be grilled and drilled her and asked: If socialism has failed everywhere it has been tried, why should the United States implement it? And what other failures should the United States try?

Nominee argues giving president more power

She needs to be asked for examples situations that President Bush should have been given more powers to regulate. And, if in the future, an much much more conservative President should take office, and he takes it upon himself/herself to get involved in personally regulating matters, will she automatically agree that this is proper?

Basically what we have here, is a sophomoric, moronic sophomore. She is eminently unqualified to manage to roadside taco truck.

Some of us have already been there, done that regarding right to homeschool. Many of those court battles were fought in the 80s. If they enact any laws forbidding it, on the evening news you’ll see parents handcuffed and dragged to jail before you pry their kids from their hands. This indeed IS a “tipping point.”

Kagan's Role Against Military Recruitment Scrutinized

It's important to her that men who engage in filthy, disease spreading sexual practices be allowed to join the military. Then, when they are promoted they will prey on those of lower ranks.
