What I’d like to know more about is what motivated the next door neighbor and owner of the house to rent it to this scumbag. Did he/she know who it was being rented to and for what purpose? Does the neighbor hate the Palins, is envious of them, is cashing in on their fame to make a buck, is a flaming lib also, or possibly all of the above. Some neighbor the Palins have. Equally as snarky as the renter is the owner.

I didn't go to law school, but I did stay at a Holiday Inn...

Most people don't know, including that McGinnis guy, that the police will not escort a trespasser off anyone's property unless the owner of the property has asked for it. If they didn't have a specification as such I could go into my local McDonald's and call the police get some stranger ejected because he looked at me funny. Imagine how many calls the police would have to deal with if they did not specify the owner and the property.

It's part of that whole property rights and just cause thing.

So, unless McGinnis has some power of attorney from the owner of the property he can't get the police to do anything.

If someone has information on if the rights of a renter being equal to the rights of the owner, that would mean something different.

LOL...you’re so full of sh!t your eyes are brown. Look up tenant’s right laws. In a lot of states, a renter can even have his landlord (the property owner himself) arrested for trespassing!!

Is it just my thinking or shouldn't a restraining order be sought against McGinnis? It's clearly stalking...I know that this is a bit off topic from the article, but I don't understand why legal action cannot be taken against this guy; he's openly admitted why he is there and if that's against the Palin's wishes and without their permission, it is clearly stalking.

Palin only has a limited number of neighbors. This particular one has the house closest to her.

Palin was able to neutralize the potential dangers to her last year by renting the property. She was unable to do so this year. Palin clearly has a less than perfect relationship with this neighbor. There is also a story out there about Palin asking the neighbor to make modifications, renovations, or something to the neighbors property. Apparently neighbor made those renovations to neighbors property and Palin didn't pay. This apparently made neighbor upset and pushed neighbor to rent to a Palin enemy.
No one here on FR really knows much about that part of the story.

Palin probably should’ve worked a bit harder to neutralize the potential dangers from neighbor house, but she did recognize those dangers, to her credit.

Someone has posted a labeled map of the area, which is very useful in understanding this story

It's a principle in law called the right to quiet enjoyment. Specifically with a domicile, a renter has the right to exclude persons from the property as they see fit, which includes calling the police to report trespassers. Of course the property owner retains certain rights to inspect and maintain the property, but any lease will stipulate the terms under which this is to be done (i.e. 48 hours notice). If the owner violates those conditions they can in fact, be prosecuted for trespassing.

You're example of a McDonald's is both a bad and good analogy. It fails because it's a public conveyance and both you and the guy that looks at you funny are guests there. It works well to illustrate my point because even if the restaurant owner is not there, the on-duty manager (or even the burger flipper), acting as an agent of the manager, could call the police and have you both escorted out. A renter of a residential property would be analogous to the McDonald's manager: not the owner, but an occupant empowered in certain areas to act in his/her capacity, and this empowerment would include the right to exclude persons from the property.

Al Baby is right. When you rent someones property, you have a “leasehold estate” on said property, and are entitled to all ownership privileges attained thereto. This includes “quiet enjoyment” of the premises.

No, actually I like Palin. The problem I’ve having is with many of her supporters, who have trouble with anything resembling complex thought. Her supporters seem to be teaching Palin that Palin can please her supporters by telling her supporters stories in the simplest manner possible. The story she told on Tuesday left out huge chunks of relevant detail. The most simple-minded of her supporters immediately called McGinniss a stalker, did not think about the details of Palin’s story at all, and immediately asked “how can we get McGinniss.” Other supporters of Palin, I’m thinking mostly of myself, did challenge the story, because the first think that jumped out at me was “how did McGinniss get that house?” Sarah can play to her base, who does not question anything she says, or can try to broaden her base to include people who will look at her story to determine whether it makes sense. I prefer Palin to Mitt Gingabee by a wide margin, but being called a Palin hater by pointing out problems with her story could drive me and others like me away.

What “allegations” do you have trouble with?

The part about not getting along well with the neighbor who rented to McGinniss?

Well, back on Tuesday, when I argued against 50 or so Palin supporters and was proven right, I suggested that McGinniss might be there as a friend. I believe that is the unlikely answer, but cannot be ruled out entirely. Perhaps things are not what they seem.

But, let’s stick with the assumption that McGinniss is enemy. So you’re saying that Palin gets along really well with the neighbor who rented to enemy? I think not.

What other allegations?

Sounds like baloney to me. That house next door doesn’t look like any major renovations have been made to it, and why in heaven’s name would the Palins be required to pay for said alleged renovations. Sounds like phony MSM started rumor or crap out of the mouth of the hostile neighbor. Hostile neighbor most likely got better offer from book author’s backers, and sold out to the highest bidder.
