And I just got this. So you think the only person the courts would accept as having standing would be the opposing candidate?

Not all candidates. But the courts have found that opposing candidates due have standing to sue if their opponent is found to be ineligible. McCain being the only real opponent with a chance to win the election, he could make a case for damages if Obama is actually ineligible.

And what a stink that would have raised if McCain had brought the suit.

Stink or no stink, if McCain believed Obama was ineligible then he should have sued. The fact that he didn't seems to indicate he doesn't take Birthers seriously.

I don’t know about the implications there. McCain has a tendency to dismiss all conservatives and conservative ideas and go with whatever will make the journalists happy.
