So just for grins, let’s suppose someone “proves” that Obama was not born in the US. What’s next?

Have him perp-walked out of the Oval? Jailed? Deported? Joe Biden sworn in as President? (that would be a Big #$%@ing Deal!)...or what?

And this would help, how exactly? Dems would somehow stop pushing for the same agenda?

Our first responsibility is to stand up for the Constitution. We deal with the consequences afterward, but keep in mind if the Democrats knowingly supported a fraud, they will lose the confidence of the citizens in this country and will be voted out of office very fast.

I believe that if Obama is found to be ineligible then his whole team would also be ineligible. They would lose by default, and McCain/Palin would be the winners. If that’s not the case it should be the case.

If someone isn’t allowed by the Constitution to be President, then remove him. Whether or not we like him is a moot point. Enforcing the Constitution, is most important.

Okay, just for grins, Impeach Zero the Magnificent, then the foul mouthed Idiot Vice President and every other politician that takes their place until we get one that will actually obey the Constitution.

No he'd act as Presdient until a President could be picked.

if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified
XXth amendment.

Now how would a President be qualified?

The person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.
XIIth amendment.

The process would not be lengthy. We'd have President McCain, since he is the only other person to have gotten electral votes for Presdient. Biden would remain VP, unless impeached for his part in the fraud/deception.

Playing along... If Biden... or whomever were to ascend to the Presidency they would immediately begin to make their own mark. This would include appointing their own Cabinet and restructuring all political appointments to suit themselves.
Sorry, but I don’t think Biden will keep Obie’s playmates in the West Wing. He will appoint lefties, but perhaps they won’t be commies.

None of that is the issue: we do have a responsibility to defend the Constitution. If there is a “there” there, then for the Constitution’s sake, it should be pursued.

That said, I think your point goes to this: asking a court, any court, to declare the President of the United States ineligible to serve is a pretty big bite. And unnecessary, in my view. If instead these plaintiffs asked the court (or Court) to find that Congress *lacked adequate procedures to safeguard the operation of the Constitution’s eligibility requirements,* that’s not so much of a stretch.

Then the Congress would have to go back and pass a law explictly stating how and to what standards it was going to evaluate the eligibility of president-elects, or even presidential nominees. They would have to set out a fact-finding procedure and even a remedy. Right now there is no prescribed process for vetting candidates. It is left to the parties, apparently. And if they say their guy is good to go, Congress doesn’t seem to question it.

It seems like it would be a good thing to get this cleared up for the future.
