The ACLU lawyers will not contest the guilt of their clients. Rather they will assert that their clients are mentally unfit to be tried because they were "tortured." So the entirety of the trial will be about what was "done to them" by Bush/Cheney et. al. with catastrophic consequences for the defense of the nation (think Abu Ghraib photos on steroids).
But this is what you get when you vote communists into power. As in all democracies the voters get what they deserve.
Problem with your theory is that 9/11 happened before they were water boarded. The 9/11 plans were in place long before Bush was in office. America is on trial, not just Bush and Cheney.
When 9/11 occurred or when it was planned is not relevant to the "defense" strategy. As I said, they do not intend to contest (at least with any vigor) the guilt of their clients. Rather, they are going to argue that their clients are not fit to stand trial because of their current mental states, and that their current mental states are a direct result of their interrogation and incarceration. So what will be argued at trial is the post-detention treatment of the accused. Airing this in a public forum is all Holder and Obama are after.
As for your remark about all America being on trial, there may be some truth to that on some level. But the goal will be to lay the blame on the Bush administration. The press will certainly be happy to play along with the narrative of a "rogue" Bush administration sullying our nation's reputation. And they get to undermine and demoralize the military and the intelligence establishment as a bonus. A progressive left three-fer as it were.
I listened to Mark Levin last night (probably a Best Of show) in which he detailed the history of Eric Holder and his involvement with pro-terrorist causes.

I agree. This is all a sham perpetrated by this WH to put Bush on trial. It’s all about vindictiveness and politics. American justice and honor take a back seat again.
They were not Mirandized. They were “tortured.” They were held for eight years.
Case dismissed. Victory for Shaikh Obama.
If the terrorists walk it will be the end of the Obama Socialist dream. Maybe that’s a good thing. If Bush and Cheney are put on trial it will rally the American people to them—just as the south was rallied to Jeff Davis when he was placed in irons after the Civil War. Will Texas give up George Bush to the Feds? Will this cause Texas to leave the Union? What if there are more and greater terrorist attacks? What if the trial inflames the radial muslems to great attacks? What if it fails to be the ultimate Blame Bush distraction to cover up Obama’s many failures? Many in the South blamed Davis for the defeat of the Confederate Cause—but when Radial Republicans tried to link him to the assassination of Lincoln and chained him up at Fort Monroe, the people of the south rallied behind their former leader with headlines like: “Manacled for our sins.”
Maybe Bush too will face this fate.
