Adames was killed after his friend, 13-year-old Billy Swan, aimed and fired a Beretta 92FS semiautomatic pistol at him. The gun belonged to Swan’s father, a Cook County sheriff’s deputy who was working as a correctional officer.

Court papers say Swan took the magazine clip out of the gun before firing it, but a single bullet that had remained in the chamber killed Adames.

A lawsuit was filed against Beretta U.S.A. Corp. and Cook County Sheriff Michael Sheahan, among other defendants, claiming that the gun maker failed to warn users that simply removing the clip did not render the gun safe.

I didn't believe that the 92FS would fire without its magazine.

However, what's with people not clearing their weapons?

This reminds of an incident I read a few years ago about a now deceased imbecile who played Russian Roulette with a .45 automatic. Should have gone second...

Bullshit. The 92FS has a “loaded chamber” indicator on the top, right-hand side of the slide.

The kid’s daddy should be sued, not Beretta.

would have read or headed any such warnings...

I call Bull Excrement. Every semi-auto weapon I've ever looked at in the last 15 years has had this warning right at the front of the owner's manual.

Apparently, the county doesn't have enough money in the coffers to pay out a princely sum to these folks, since the primary person responsible here is a deputy.

The deputy and his son should be on the ones being sued for wrongful death, 2nd degree murder, failure to train the son in proper firearms handling and failure to properly store the firearm from access by minors. Beretta has no responsibility at all in this instance.

Great! Now we want to be able to sue Obama Motors, etc for car deaths and injuries.
I want a trillion bucks for the auto accident where my dad fell asleep at the wheel and crashed, dying of injuries.
All the car company’s fault for making cars that can exceed a walking pace.

If cars could not exceed a walking pace, lives would be saved.

It is worth it if even one life is saved.
