A U.S. Army Reserve major from Florida scheduled to report for deployment to Afghanistan within days has had his military orders revoked after arguing he should not be required to serve under a president who has not proven his eligibility for office.

His attorney, Orly Taitz, confirmed to WND the military has rescinded his impending deployment orders.

…A hearing on the questions raised by Maj. Stefan Frederick Cook, an engineer who told WND he wants to serve his country in Afghanistan, was scheduled for July 16 at 9:30 a.m.

…”As an officer in the armed forces of the United States, it is [my] duty to gain clarification on any order we may believe illegal. With that said, if President Obama is found not to be a ‘natural-born citizen,’ he is not eligible to be commander-in-chief,” he told WND only hours after the case was filed.

“[Then] any order coming out of the presidency or his chain of command is illegal. Should I deploy, I would essentially be following an illegal [order]. If I happened to be captured by the enemy in a foreign land, I would not be privy to the Geneva Convention protections,” he said.

The order for the hearing in the federal court for the Middle District of Georgia from U.S. District Judge Clay D. Land said the hearing on the request for a temporary restraining order would be held Thursday.

…[Cook] said the vast array of information about Obama that is not available to the public confirms to him “something is amiss.”

“That and the fact the individual who is occupying the White House has not been entirely truthful with anybody,” he said. “Every time anyone has made an inquiry, it has been either cast aside, it has been maligned, it has been laughed at or just dismissed summarily without further investigation.

“You know what. It would be so simple to solve. Just produce the long-form document, certificate of live birth,” he said.

…He told WND he would be prepared for a backlash against him as a military officer, since members of the military swear to uphold and follow their orders. However, he noted that following an illegal order would be just as bad as failing to follow a legal order.

Update: Guess the DoD has “compelled the termination” of the plaintiff. How predictably rich. It’s a $7 document Barry, given the billions being funneled to Acorn via your porkulous boondoggle, can’t one of their thugs buy or make a counterfeit? Zheesh.

hold on a sec...what does ‘compelled the termination’ mean? was he drummed out of the service? retired on the spot? what would happen if a majority of soldiers filed a class action? would they be ‘terminated’ also?

The company he worked for - I can't recall the name - did some government work. Word is that the government - possible pentagon -insinuated that contracts would be terminated unless he was let go.

Highly corrupt, highly illegal, just another day in the Obmamanation.

The DoD directed a DoD contractor for whom Cook worked to fire Cook. Great suit ahead, not to mention a book in a few years. This raghead Kenyan is going down.

I read that in the link you provided, I don't think it is true. Even as a reservist you can not pick and choose your orders. You can certainly request a specific assignment, but you can't have orders in hand and then decide you don't like them. I may be wrong, but when I was in the service we had reservist that served along side us and they were subject to the same rules we were; And I sure as hell could not get orders changed just because I did not like them. Otherwise I would not have spent 4 years in Altus Oklahoma.

Major Cook told Steve Malzberg on Thursday that the DoD pulled his clearance, which meant that he would no longer able to do the type of work he was doing for Simtech Inc.

He did not explain what that work was.

The company is Simtech. As I understand it, Simtech is a family-owned company with one customer, the DoD.

Major Cook is a patriot in my opinion. Those who signed the Declaration of Independence pledged their lives, their fortunes and their sacred honor. It is definitely costing Major Cook a fortune to pursue removing this foreigner in the People’s House.

wow. I’m a little stunned at the brazenness - this news will spread thru the ranks like lightening. Zero’s efforts to demoralize every non-ethnic group in the country are at best pathetically laughable, but he is certainly playing with fire when he goes after our military and their ability to feed their families.

How much longer before we get to impeach the pie-eater?

Hang on here. You said that because he “volunteered” to go to Afghanistan he can then “un volunteer”? Doesn’t sound right since it would mean an individual who volunteers to join the military can at any time do the same thing and “un volunteer”. Besides if you were right I believe the DoD would have said exactly that.

if it’s this Simtech, they make corrosion-resistant pipe and valves (pvc, etc) for water/watertreatment and other fluids, as well as specialized ducting.

This USA Today link has more info and additional links.

It seems that last May, Cook volunteered for active duty (that is, the military didn't call up him or his group for active duty) in Afghanistan. The military has an opt out clause for reservists who volunteer for active duty: they're allowed to change their mind up until the day of deployment.

All I know is what he told Steve Malzberg: that he requires clearance to do his civilian job, and that the DoD pulled his clearance.

“In all cases, whether Guard or Reserve, members ordered to Extended Active Duty (EAD) — such as for a deployment to Iraq or Afghanistan — are subject to the UCMJ. Guard and Reserve members who refuse or fail to comply with EAD orders, or go absent while on EAD are treated the exact same way as active duty members who go AWOL.”
