Why We Fight: "No Legislation Without Representation"
The Constitutional Alamo ^ | 07/03/09 | Michael Naragon

The real issue that brought many of the Revolutionary patriots into the fight was a lack of representation. The government was passing laws while remaining deaf to the protests of its constituencies. Is this 1776 or 2009?

Our current Congress and administration are the most elitist, most distant governing bodies our nation has yet known. In the midst of the highest unemployment numbers in 26 years, our president exudes confidence.

“I’m absolutely confident that we can, at this period of difficulty, prove, once again, what this nation can achieve when challenged,” Obama told reporters Thursday. Attempts to spread confidence in dark times is normally admirable, but not for a man who has, for months, attempted to destroy confidence and spread fear of financial oblivion in order to pass his Marxist agenda.

The president used the press briefing to push that agenda, making reference to the passage of the cap-and-trade bill by the House this week.

“It’s now up to the Senate to continue the work that was begun in the House to forge this more prosperous future,” Obama said. “We’re going to need to set aside the posturing and the politics, and when we put aside the old ideological debates, then our choice is clear.” By the “posturing and the politics,” I would presume he means the resistance to this slavery mandate that has been opposed by a vast majority of Americans, many of whom will be showing their disgust of the House’s ruling this weekend. Millions of phone calls and e-mails to representatives demanding they vote against cap-and-trade were ignored.

Obama has repeatedly promised transparency and openness. We have received none. What we have received, instead, are admonitions to accept his takeover of our country without “posturing.”

Thousands–perhaps millions–of us will head to area Tea Parties this weekend to show our displeasure with our federal government. The root cause is an oldie, but not a goodie.

How about "No Legislation until the freaking bill actually exists?"

Really, if the text of the Bill is not actually written and filed with the clerk of the House, can it actually, LEGALLY, be voted upon? Is there a "revise and extend my Bill" privilege? I think not. I suspect SCOTUS could rule on this. Yes, both Houses are empowered under the Constitution to set their own Rules, but those Rules CANNOT violate the Constitution. Of course, We The People don't seem to have standing on matters like this.

It can be argued that, in fact, true representation does not exist across the nation. The political class has gerrymandered safe districts and passed campaign finance “reform” laws designed to protect incumbents by putting in place obastacles to challengers that make a successful challenge a long shot. Add to this the climate in D.C. that seems to sway virtually all, even the most determinedly independent, to conform to the common concensus (”go along to get along”) and away from the concerns of their constituents. The result is a body of “lawmakers” who feel little accountability and little, if any, concern for the unreal (because distant) demands of those they are supposed to represent.

In other words we do not have true representation. Instead we have an entrenched special interest group of 545 people who are more concerned about making sure the bureaucracy thrives and their own power and prestige go as near to unchallenged as possible. And they are busily working to ensure that their power grows and the ability to challenge them is further reduced. Such legislation as “Cap and Tax”, health care “reform” and “hate crime” laws serve to give the bureaucracy more coercive power and to muzzle opposition by simply labeling it a “hate crime” to criticize our rulers. The courts will back these efforts for the most part and whatever resistance remains in the judicial branch will be weeded out as time takes its toll on orginalists and they are replaced by those who will play ball.

It has taken decades to so undermine the constitution as to render it irrelevent. There is no support for it among our rulers (individual exceptions exist but they are a decided minority). All three branches are compromised. I see no solution to this - no peaceful solution anyway. I sincerely hope I am wrong about that.

Indeed, the voting for bills not read is an insult to the constituents AND gross neglect.

Indeed, the solution is bitter, but the blood of tyrants will solve the problem... especially if they’re shed in the legal arena: i.e. Murtha being charged w/ treason (Haditha Marines) and then hung if/when found guilty.

An insult that must be addressed in a tangible way... the vote in 2010 is crucial. Democrats and liberal Republicans believe they can impose their will on us and that we, like sheep, will send them back to Washington where they can continue to ignore us. It cannot continue.
