Reasons Why John Demjanjuk Should Not Be Deported
April 16,2009 | Welcome2thejungle

Posted on 04/16/2009 10:42:12 AM PDT by Welcome2thejungle

1) Demjanjuk is 89 years old, senile, and in very poor health. How would you punish such a man?

2) Demjanjuk's 1988 conviction of war crimes was subsequently overturned by Israel's highest court because there was reasonable doubt that he was "Ivan the Terrible".

3) Demjanjuk was a lowly camp guard, not an SS officer or camp commandant. He certainly was no major international war criminal in the same league with Adolf Eichmann.

4) The USSR under Joseph Stalin and Communist China under Chairman Mao slaughtered millions more innocent people than did the Nazis. Why no round up and international manhunt for their camp guards and exectioners?

5) WWII ended 64 years ago and it is doubtful that surviving witnesses could positively identify Demjanjuk.

The fact remains brutal things happen in war. Of course major war criminals should be prosecuted and brought to justice for their crimes like the Nazi leaders at Nuremburg and Saddam Hussein and Slobodon Milosevic as well as their leading henchmen. But in the larger scheme of things, Demjanjuk was a lowly foot soldier recruited by the invading Germans to serve as a camp guard. His alternatives at the time were probably not much better. He could have been forced to work as a slave laborer in an armaments factory. Not everyone in Nazi occupied Europe was an Oscar Shindler. Most in fact did what they could to get along and survive the war. And when the Germans invaded the USSR they were initially welcomed as liberators by native populations who had already endured horrific savergy under the Soviet oppression. The choices were not easy.

Demjanjuk has already been been punished and should be left alone. He was a low level Ukrainian peasant whose land was conquered and terrorized by two equally evil and murderous totalitarian regimes. His choices were not easy. The best choice this man ever made was to move to the United States where he found peace, at least for a while. The Israeli court overturned his conviction and returned to him America. That should be enough for this low level camp guard.

Does it not matter that Israel’s highest court overturned his conviction

On a technicality. Also, he lied to get into this country, and is no better than your run of the mill illegal alien.

Whats your bag, newbie? Are you a Patsie Buchanan fan?

I don’t have audio. Why are the Germans so anxious to prosecute Demjanjuk?

Does it not matter that Israel’s highest court overturned his conviction?

Not necessarily. The article says the Israeli court overturned his conviction because there was a "reasonable doubt" that he was not a particular war criminal.

In US deportation cases, however, the government only needs to prove their case by "clear and convincing evidence." This is a lower standard than "beyond a reasonable doubt." Similarly, the government doesn't need to prove that he committed certain atrocities or was some kind of high-level Nazi leader, only that he "participated in the persecution of any person" under the direction of the Nazis...such as serving as a concentration camp guard. I'm guessing this too is a lower standard than was required for an Israeli conviction.

Demjanjuk is the least of my worries these days.

Then you wouldnt be blogging about him. Fact is, he WAS a sadistic prison guard and I personally don't give a fig how old the old fart is, let him pay the piper.

Simply a “social justice” issue for Germany and because Demjanjuk was Ukranian, not German.

That's strange. I heard the professor's voice yesterday, when I played that video, but can't now.

My grandfather had the experience of dealing with ‘lowly camp guards’ in Buchenwald (http://en.wikipedia.org/wiki/Buchenwald), with men similar to Demjanjuk. I’m sure any of those surviving ‘lowly camp guards’ are old, senile, and pathetic men today.

These ‘lowly camp guards’ went above and beyond the call of duty of what was required of them, and found pleasure in torturing, murdering, and raping other human beings.

These ‘lowly camp guards’ ultimate judgement will come eventually, but before that takes place, they ought to have judgement passed on them by man, regardless of how old and pathetic they have become.

Well if they can deport a senile old man like Demjankuk who committed these crimes 64 years ago and could not harm a fly today, why won’t they lift a freaking finger to deport thousands of illegal alien criminals who commit violent crimes against innocent people on a daily basis here in LA? Here in my city, the LAPD is not even permitted to ask a suspect if they are in this country legally. Now isn’t that really twisted? I’ll tell you what: I would take Demjanjuk in my neighborhood if we could deport all these illegal violent gangbangers, drug dealers, and vicious criminals aliens living in my city. Deal?

He was a “lowly camp guard” that probably executed people.

What's the difference between your argument and this one, “He's just a poor little abused boy that became a gang banger and shot and killed several people?”

NOTHING listed is an argument.

It is relevant, just not a reason to let lesser crimes off the hook. No one is under the law, no one is above the law.

Yes, all true. But Demjanjuk had his day in court. His 1988 conviction was overturned by Israel’s highest court and he was returned to America. That should have settled the matter. After so many years it would now be difficult for any surviving witnesses to identify Demjanjuk. Everyone should have a fair trial with witnesses and proof presented. Even Eichmann was accorded this in his very extensive and thorough trial.

Why, yes we can deport them, and we should if they are found.

Nice of the Germans to round up a Ukrainian as the guard responsible. Did they try all the German guards already?

I was simply offering my opinion about him because he is back in the news again. I think we have a dangerous criminals living here in our country who are much more dangerous and should be deported. Demjanjuk right now is completely harmless and would be near the last on my list to be deported. There are others who should be deported ahead of him including POTUS—Back to Kenya for that freaking socialist who is doing a lot of harm to our once great republic!

Well, they don’t. LA is overwhelmed with illegal aliens and no one lifts a finger. You can’t even drive into a Home Depot with being accosted by hundreds of them. No, they go after the easy targets: Like an eighty nine year old senile man confined to a wheel chair, who ALREADY went to Israel and faced the court. How truly freaked up this country is!

Watch for May 1st. Then you will see hundreds of thousands of illegal aliens marching in the streets demanding their “rights”. Meanwhile all the feds want to do is ship Demjanjuk back to Germany for their little show trial. How pathetic!

He wasnt found"not guilty", they overturned it on a technicality becuae one of the peieces of evidence had an alias of him on the paper, instead of his current name. A TECHNICALITY.

The guy was a sadistic brute and I dont give a fig about him . Why do you?? Are you a Holocaust Denier? Cant you find something else to whine about, newbie?

When did FR become sympathetic to criminals whose convictions are overturned on technicalities?
